HomeMy WebLinkAboutCAMPUS WEST TEXACO NON CONFORMING USE - 47 90 - SUBMITTAL DOCUMENTS - ROUND 1 - SUBMITTAL CHECKLISTNon —Conforming Use Review City of Fort Collins Section 29-541 of the Code of the City of Fort Collins provides for Planning and Zoning Board approval of a change of a non -conforming use and enlargement of a building containing a non -conforming use. A non -conforming use is defined as any legally existing use which does not conform to the use regulations of the zoning district classification in which the use is located, either at the effective date of the zoning ordinance or as a result of zoning changes which may be made over the years to the property. The process which the applicant will follow in changing the use or enlarging a building containing a non -conforming use will be as indicated in the section of this manual entitled "Review Process." The following issues must be considered in an analysis and evaluation of a change in a non -conforming use or an enlarge- ment of a building containing a non -conforming use: 1. Change of Use If a property owner wishes to change the use of a property already containing a non- conforming use to a use other than what is allowed in the zoning district, the proposal must be submitted to the Planning and Zoning Board for approval. In considering a proposed change, the Planning and Zoning Board must make a finding as to whether or not the change in use is more compatible with the uses of the surrounding property than the existing non -conforming use. For the purposes of review, the following criteria shall be considered: a. The nature and purpose of the existing non -conforming use. b. The difference in quality and character of the proposed use. c. The difference in the degree of use of the proposed use, including but not limited to hours of operation and parking requirements. d. The reasons for the proposed change. e. The overall impact of the proposed use on the surrounding property. 2. Enlargement of Building Containing a Non -Conforming Use If a property owner wishes to enlarge or extend a building containing a non -conforming use, the proposal must be submitted for approval to the Planning and Zoning Board. In considering the enlargement or extension of a building containing a non -conforming use, the Board must make a finding as to whether or not the enlargement or extension will adversely affect the surrounding property. For the purposes of review, the following criteria will be considered: a. The nature of the proposed expansion or extension. b. The size of the proposed expansion or extension. c. The difference in the degree of use of the non -conforming use as a result of the proposed expansion or extension. d. The reasons for the proposed expansion or extension. e. The overall impact of the proposed expansion or extension on the surrounding property. ll/[4/40 : � 6.1 Continued Submittal Reauirements For either the enlargement or change of a non -conforming use, the submittal must include the following information and data: Application form (1 copy) and filing fee ($110.00). (25 copies) and Ian ca a plan (16 copies) each folded to fit into a legal -size ol'f der with the project name- s &Aowing. -The site plan and landscape plan must contain all information and requirements as listed in the section of this manual entitled "Submittal Requirements for Site Plans". D. A current list of names and addresses of all owners of record of real property within 500 feet of the property lines of the parcel of land for which the change or enlargement of to �� non -conforming use is proposed, exclusive of public right-of-way. (This information is Y" ailable from the Assessor's Office in the Larimer County Courthouse or from local title companies.) This list must be typed on 8-1/2" x 11" sheet -type mailing labels (33 labels per sheet) by the applicant. ay'C E. Statement of planning objectives (25 copies) including evidence in support of the proposal based on the above review criteria. F. Land use data (1 copy) typed on 8-1 /2" x 1 t" sheet, showing the information as required in the section of this manual entitled "Submittal Requirements for Site Plans". G. Architectural elevations (5 copies folded to fit into a legal -size folder with the project name showing) of all buildings to be constructed, sufficient to convey the basic architectu- ral intent of the proposed improvements, including but not limited to colors and type of ,kexterior building materials. The elevations should be at an appropriate scale, on sheets with an outer dimension of 24" x 36". H. One colored rendering (unfolded). ten folded full-size sets of all plans and an 8-1/2" x II" PMT or comparable quality reduction (xerox copies are not acceptable) of all plans to be submitted one week prior to the Planning and Zoning Board hearing. Signed reproducible molar of all plans to be submitted two working days prior to the Planning and Zoning Board hearing. Signed "Site and Landscape Covenant" (one copy), sample copies are available from the Development Review Center, to be submitted two working days prior to the Planning and Zoning Board hearing. K. Other documentation as determined by special circumstances. 6.2
