This letter is to inform you that we received a complaint that a shipping container at the above- mentioned address without obtaining a permit or inspections. Our records do not indicate that a permit was ever issued and is in violation of the 2018 International Residential Code (IRC) as adopted by the City of Fort Collins. 2018 IRC Sections: R105.1 Required. Any owner or owner's authorized agent who intends to construct, enlarge, alter, repair, move, demolish or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing system, the installation of which is regulated by this code, or to cause any such work to be performed, shall first make application to the building official and obtain the required permit. R105.2 Work exempt from permit. Exemption from permit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction. Permits shall not be required for the following: Building: 1. One-story detached accessory structures for lawn and garden equipment storage, tool storage and similar uses, including arbors, pergolas, and similar structures, provided the floor area does not exceed 120 square feet or 8 feet in height, do not house flammable liquids in quantities exceeding 10 gallons per building and are located at least 3 feet from an adjoining property line. The shipping container is over 8'feet tall and over 120 square feet and as such, requires a building permit. This notice allows you 30 days from the date of this letter to obtain a building permit for the new structure or to remove the structure in its entirety. Please notify me within 30 days of the date of this letter to verify that the above items have been corrected. Pursuant with City Code Chapter 1 section 15 and Chapter 5 article II division 3, Failure to comply with this notice of violation is grounds for the City of Fort Collins to issue you a citation to appear in court and fines up to 3,000.00 dollars per day from the date of the violation.
