This letter is to inform you that we have received a complaint about the grading and drainage at the above-mentioned address. After investigating, it has been determined that the grading and drainage for units 1-205 is in violation of the 2006 International Property Maintenance code {IPMC) as adopted by the City of Fort Collins. The streets and gutters are sloped back to each individual lot discharging water towards mobile homes and other structures. This can cause erosion of soil, stagnant water and damage to structures. The grading and drainage shall be repaired within 30 days of the date of this letter. Please notify me to verify that the above items have been corrected. 2006 IPMC Sections: 302.2 Grading and Drainage. All premises shall be graded and maintained to prevent the erosion of soil and to prevent the accumulation of stagnant water thereon, or within any structure located thereon. Drainage of paved areas, yards and courts, and other open areas on the premises shall not be discharged in a manner that creates a public nuisance. Abandoned or unprotected excavations shall be considered a nuisance and shall be filled to the original or adjoining site elevation. Exception: Approved retention areas and reservoirs and temporary retention ponds, detention ponds, channels and other water features such as pools, ponds, and similar approved excavations designed for recreational or aesthetic purposes that are maintained in a condition that does not pose a health or safety hazard, or a public nuisance. Pursuant with City Code Chapter 1 section 15 and Chapter 5 article II division 3, Failure to comply with this notice of violation is grounds for the City of Fort Collins to issue you a citation to appear in court and fines up to 3,000/;Jrs per day from the date of the violation.
