On Friday, June 5, 1987, we held a discussion in your office concerning
our Health Care International submittal on south Lemay Avenue. At that
time you advised me that the City wanted us to dedicate the entire
to width of Rule Drive from Lemay Avenue to the western property
line of the parcel. You stated two reasons for this requirement, first
that the City would need to reserve the area for the future possibility
of looping water and sewer utilities, and second, the City wanted to
reserve the right to extend Rule Drive to the west at some point in the
future if at some point in the future it was found to be necessary.
Other discussions we have had recentlty concern the planning and
construction of Lemay Avenue in front of the HCI site and other of our
developments a -long Lemay as this planning and construction relates to
Special Improvement District Number 78,
,As you know, we disagree in our opinion as to what the City can.
legitimately require of us regarding both Rule Drive and Lemay Avenue.
Because we are dealing with legal issues in both instances, and because I
do not want our continuing discussions on these topics to delay the final
approval of the project, I would like to suggest that we set a
meeting with our attorney and the City Attorney's Office to resolve the
legal questions so that we can proceed through the submittal process in a
timely manner.
This project is extremely important, and I
