College Ave, PO Box 580, Fort Collins, CO 80522, (970) 416-2745 F: (970) 224-6134 April 2, 2019 Modification of Standards Request for: 1609 Oakridge Drive, Fort Collins, Colorado 80525 Michele Rosemann, Sole Managing Member of Immersion Dance Center, LLC (IDC), is requesting the modification of standard described herein in support of IDC's desire to enter into a lease to operate a Dance Studio in Suite 140 of the subject address. The applicant is requesting a modification of standards for the following: Land Use Code section 4.26(D)(2), which states that 'All secondary uses shall be integrated both in function and appearance into a larger employment -based development plan that emphasizes primary uses. A secondary use shall be subject to administrative review or Planning and Zoning Board review as required for such use in subsection 4.26(B). The following permitted uses shall be considered secondary uses in this zone district and together shall occupy no more than twenty-five (25) percent of the total gross area of the development plan. The following uses are permitted in the H-C District, subject to Planning and Zoning Board review:' Standards: City of Fort Collins Land Use Code Article 4 — Districts Division 4.26 - Harmony Corridor District (H-C) 4.26(B) — Permitted Uses. 4.26(B)(3) — The following uses are permitted in the H-C District, subject to Planning and Zoning Board review 4.26(B)(3)(c) — Commercial/Retail Uses 4.26(B)(3)(c)13 — Limited indoor recreation establishments 4.26(D) — Land Use Standards 4.26(D)(2) — Secondary Uses 4.26(D)(2)p — Limited indoor recreation establishments Discussion: IDC's use as a dance studio is a "Limited indoor recreation establishment", which is a permitted Commercial/Retail use in accordance with 4.26(13)(3)(c)13., subject to Planning and Zoning Board review. Per 4.26(D)(2), Secondary Uses (including Limited indoor recreation establishments) shall not exceed twenty-five (25) percent of the total gross area of the development plan. IDC desires to occupy Suite 140, which is the only non -Primary Use on the site, and which represents 12.1% of the total gross square footage of the site (3,622 SF / 29,850 SF) known as Oakridge Business Park PUD Seventh. The purpose of the Harmony Corridor Plan is to create an attractive and complete mixed -use area with a major employment base. In addition to employing 5 individuals, IDC attracts more than 180 students and their families to its studio on a weekly basis. Many of these students and their families live outside of the Harmony Corridor and many outside of the City of Fort Collins' boundary. Thus, IDC is attracting employees and families to the Harmony Corridor; which strengthens surrounding businesses, as well as the Harmony Corridor itself. Page 1 of 2 Since IDC's business supports the Harmony Corridor Plan and the Oakridge Business Park PUD Seventh site will remain well below the 25% Secondary Use limit with IDC operating in Suite 140; 1 respectively request that the City Staff and/or the Planning and Zoning Board permit and approve 1609 Oakridge, Suite 140 to be a Limited Indoor Recreation Establishment (Secondary Use).
