HomeMy WebLinkAboutREGISTRY RIDGE SEVENTH FILING - Filed OA-OTHER AGREEMENTS - 2016-09-07PLAT CERTIFICATION DISCLOSURE REGISTRY RIDGE (SEVENTH FILING) Pursuant to City Code Section 2.2.3 (C)(3)(f), Visani Bargell LLC, on behalf of BQ, LLC (Owner) based on review of the Title Commitment issued by Land Title Guarantee Company effective May 10, 2016 makes the following clarifying Certification disclosures: 1. Section 2.2.3(C) (3)(b) BQ SHALL NOT ENTER INTO ANY CONTRACT FOR PURCHASE THAT SHALL TAKE, INJURE, DIMINISH OR WEAKEN THE CITY'S INTEREST IN ANY LAND, EASEMENT OR RIGHT-OF-WAY DEDICATED TO THE CITY OR THE PUBLIC ON THE PLAT. 2. Section 2.2.3(C) (3) (e). The following documents or easement rights have been identified of record, but securing Plat signatories is impracticable or not possible. a. AN EASEMENT FOR ELECTRIC TRANSMISSION OR DISTRIBUTION LINES AND INCIDENTAL PURPOSES GRANTED TO POUDRE VALLEY RURAL ELECTRIC ASSOCIATION, INC., AS SET FORTH IN AN INSTRUMENT RECORDED AUGUST 25,1980 IN BOOK 2064 AT PAGE 695 (.EASEMENT DATED NOVEMBER 26,1941). b. COVENANTS, CONDITIONS, RESTRICTIONS AND PROVISIONS AS SET FORTH IN CONDOMINIUM DECLARATION FOR LIBERTY AT REGISTRY RIDGE CONDOMINIUM COMMUNITY RECORDED OCTOBER 16, 2008 AT RECEPTION NO.20080065298, AS AMENDED. THE PLATTED PROPERTY IS IDENTIFIED AS ANNEXABLE, BUT NO OBLIGATION TO ANNEX EXISTS. c. THE SURFACE ESTATE OF THE PROPERTY MAY BE OWNED SEPARATELY FROM THE UNDERLYING MINERAL ESTATE, AND TRANSFER OF THE SURFACE ESTATE MAY NOT INCLUDE TRANSFER OF THE MINERAL ESTATE. THIRD PARTIES MAY OWN OR LEASE INTERESTS IN OIL, GAS, OR OTHER MINERALS UNDER THE SURFACE, AND THEY MAY ENTER AND USE THE SURFACE ESTATE TO ACCESS THE MINERAL ESTATE.
