SERVICE UNIT OF THE CITY OF FORT COLLINS
VACATING A DRAINAGE EASEMENT LOCATED ON LOT 1, EVERGREEN PARK
FOURTH FILING
WHEREAS, Section 2.1.5 of the Land Use Code of the City of Fort Collins
authorizes the Director of Planning, Development, and Transportation Service Unit to
vacate certain easements by resolution or by approval of replats containing notation of
such dedication; and
WHEREAS, the Owner has requested that the City vacate a drainage easement
on lot 1, Evergreen Park Fourth Filing, as more particularly described on Exhibit "A".
WHEREAS, the vacation has been reviewed and approved by the pertinent City
Departments and utility providers, which departments and utility providers report no
objection to the vacation.
NOW, THEREFORE, be it resolved by the Director of Planning, Development,
and Transportation Service Unit of the City of Fort Collins, that the drainage easement
on Lot 1, Evergreen Park Fourth Filing, as more particularly described on Exhibit "A",
attached hereto and incorporated herein by this reference, is hereby vacated.
Passed and adopted by the Director of Planning, Development and Transportation
Service Unit of the City of Fort Collins this I- day of October 2013.

That portion of Lot 1; EVERGREEN PARK FOURTH FILING, City of Fort Collins,
Colorado, situate in the Northwest Quarter of Section 1, Township 7 North, Range 69 West of
the 6th P.M., City of Port Collins, County of .Lari.mer, State of Colorado, being more
particularly described as follows;
Considering the East line of said Lot I as bearing North 00°00'00" West and with all bearings
contained herein relative thereto;
BEGINNING at. the Northeast corner of said Lot 1; thence along the North line of said Lot 1,
North 89°58'05" West 83.00 feet to the Northwest corner of an existing Drainage Easement;
thence departing said. North line and along the boundary lines of said existing Drainage
Easement the following eight (8) courses and distances South 00'01'55" West 87.59 feet;
thence South 77°47'53" West 32.17 feet; thence South 40*34' 18" West 25.70 feet; thence
South 86°48' 19" West 107.03 feet; thence South 00°01'55" West 20.03 feet; thence North
86'48'19" East 119.86 feet; thence South 40025'42" East 46.49 feet; thence South 00101'55"
West 36.49 feet to a point on the South line of said Lot l; thence along said South line, South
89°58'30" East 83.11 feet to the Southeast corner of said Lot 1; thence along the East line of
