Constr. Permit — Refers to a Sidewalk Permit for Multi -Use Path — I would look either for deletion of this paragraph or for some clarification on timeline as this is a future site improvement. At the request of our attorney, I have removed the sidewalk obligations from the development agreement and this will be handled with a separate memo between COFC Utilities and COFC Engineering. If COFC Utilities and CEC would like to add language to the development agreement about reimbursement for the fence costs that is ok with me. I believe that Norm is working on a separate memo that will address this as well. Regarding the responsibilities for landscaping and the Habitat Buffer Area plantings, I was not part of those discussions so I am not sure who is responsible. The language that I received from Stephanie and Lindsay from Natural Areas references the Developer (CEC) is responsible. See section ILE on page 5, 6, 7 of the agreement. If we need to change the language to Owner (COFC Utilities) is responsible please let me know. You may want to set up a meeting with Stephanie and/or Lindsay to confirm this so we are all on the same page. Please review the agreement and let me know if you have any revisions, questions or concerns.
