PRO= DESCRIPTION AND SITE ANALYSIS: The applicant is proposing two multiple family dwelling units on two lots totalling .08751 acres in area. The property consists of Lots 7 and 8, Block 1 of the 1985 Amended Plat of Terry Point Estates. The smaller lot (16,337 sq. ft.) will contain the proposed three-plex, while the larger lot (21,781 sq. ft.) will contain the proposed four-plex. The property is located adjacent of the North shore of Terry Lake. Access to the site will be from Terry Point Drive. III. COMPATIBILITY: Lots 7 and 8 are two of thirty-one lots in Terry Point Estates zoned M- Multiple Family. The remaining 59 lots are zoned R or R-1 Residential. The lots in Terry Point Estates average between one-third and one-half acre each. The project is generally surrounded by single family residential subdivisions and undeveloped land. To the north is Tri-View Estates with twelve lots averaging approximately two acres each. Northeast exists Evans Subdivision and Cherry Hills Court averaging three-quarters of an acre (53 lots) and one-half of an acre (40 lots) respectively. To the east is Terry Shores which has 100 lots averaging two-thirds of an acre each. Just west of Terry Point Estates is the Terry Acres Subdivision which has six lots averaging approximately four and one-third acres each. IV. MAJOR ISSUES AND CONCERNS: 1. Terry Point Estates was originally platted on November 8, 1967. The M-Multiple Family Zoning was approved on September 23, 1971. The proposed planned unit development will merely allow the dwelling units to be sold individually so they will be owner -occupied rather than rental units. Nothing else is being changed. 2. The overall density is established by the size of each lot. The present subdivision plat would allow a total of 46 dwelling units (8 units per acre or 5445 sq. ft. per unit). Under a P.U.D., the applicant could propose increasing the density to ten units per acre but he has not requested any change in the total number of dwelling units. 3. Water, sewer, drainage and road improvements are being constructed through a special improvement district that was approved by the Board of County Commissioners. The water and sewer districts have cc mitted to serve this project. The County Special Districts Administrator reviewed the proposed P.U.D. and stated no objections. 4. The City of Fort Collins Planning and Zoning Board recommended approval of this project and approval of the waiver of the off -site street capacity requirement with the following conditions: a. The developer is strongly encouraged to leave an area of land at the water's edge in a natural state to lessen the potential degradation of the water from erosion and the run-off of fertilizer and other matter. b. The developer shall pay the Off -site Street Improvement Ordinance Waiver fee to Larimer County. 5. The County Health and Engineering Departments have reviewed this project and stated no objections. 6. The Division of Wildlife recorm►ends that prospective buyers be warned of the existing problems with Canadian Geese causing damage to landscaping. 7. The Poudre Fire Authority indicates that the water line capacity must be verified by the water district as supplying 1000 GPM fire flow at 20 PSI residual pressure. LARIMER COUNTY PC 6/17/87 SUBJECT THE POINT PUD PLANNING STAFF REPORT PAGE 7 V. STAFF FINDINGS: I. Terry Point Subdivision was approved on November 8, 1967. 2. All of the lots in this proposed P.U.D. were zoned M-Multiple Family on September 23, 1971. 3. The proposed P.U.D. is intended to change the ownership of the project from a landlord -tenant situation to individual ownership of each dwelling unit. 4. Utilities, drainage and streets are being constructed under a special improvement district that was approved by the Board of County Cormissioners. 5. Approval of The Point P.U.D. will not result in any significant negative impacts on surrounding properties, utility services, transportation facilties or the natural environment. VI. STAFF RECOMMENDATION: Approval of the waiver of the off -site street capacity requirement of the Urban Growth Area Agreement. Approval of the master plan and preliminary phase plan of The Point P.U.D. with the following conditions: 1. The developer shall pay the off -site street capacity waiver fee prior to recording of the final plat. 2. Prior to approval of a final plat, the applicant shall verify with the East Larimer County Water District that the water lines in this project will supply the fire flows required by the Larimer County Water, Sewer and Fire Safety Manual.
