I have received input from the appropriate City Staff in addressing your issues. The following applies: Justice Center Drainage Easement The drainage easement will reduce the developable area left for City use. As we discussed last week, the division of Block 31 was based on each entity receiving equal parcels of developable property; therefore, I'm recommending that the City be compensated for the drainage easement @ 50% of fee value = $28,500. Easements for Commercial Space in Parking Garage In reviewing the ground lease, it calls for the location of additional easements to be identified and shown on the Plans and Specifications approved by the City. Since City Code requires that easements must be approved by City Council, we do need to have them described separately. Upon reflection, it is probably best to have the specific locations of public record. If you have any questions, please feel to give me a call at (970)221-6274.
