This facility is my next door neighbor. The majority of the facility's western boundary is adjacent to our property, and the majority of the facilitiy's northern boundary is adjacent to my neighbor, Karin Livingston (Scott died earlier this summer of a heart attack). I am aware that the city has plans to expand the Vehicle Repair building on this site and that the City believes that eventually they will need to build an office building on this site to accomodate people currently working downtown. I believe that these are reasonable plans for the City's property at this location, but would like to ensure that as development plans are actually funded and implemented, the City continue to work with Karin, Gregg, and myself to ensure a cooperative approach to development. Our primary concerns in this regard are screening and employee access to these facilities. I have no objections to the proposed change in zoning, as it appears to me that the new zoning is more consistent with what is actually happening on this site today and in the future. I would like to correct some misimpressions contained in the Staff Report, however. The report states that property to the east and west of the parcel requesting the rezoning is currently zoned "E". It is true that land east and SOUTHwest of the current parcel is 'E", but the land west and north is currently in the County and zoned "O", 1 believe. The report states that "O" is Undeveloped land, and implies therefore that the land west and north is undeveloped. The actual use of the adjacent parcels is single family residential with more acreage than your typical city property. My understanding of the Open zoning designation is simply that this land can have many uses. appreciate the opportunity to understand what plans the City is making. Best Regards, Connie Doster 910 N. Our main complaints with our City neighbor, the Vehicle Storage and Operations Service Center, have to do with excessive bright lights and the awful noise at all hours of the night from heavy equipment with it's piercing back-up warning beeping (whatever happened to the thoughts of retrofitting these vehicles with less annoying backup warning systems?). No members of the neighborhood attended this meeting. The Current Planning Department did receive a phone call from Mrs. Dinkleman, 620 Park Street, concerning the provision of adequate screening with the new facility. An e-mail was sent from Connie Doster (attached), also concerned with screening and excessive lighting of the new facility. ATTEST: City Clerk Mayor ORDINANCE NO. 138, 2003 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING THE ZONING MAP OF THE CITY OF FORT COLLINS BY CHANGING THE ZONING CLASSIFICATION FOR THAT CERTAIN PROPERTY KNOWN AS THE CITY OF FORT COLLINS VEHICLE STORAGE AND OPERATIONS SERVICE MAINTENANCE FACILITY REZONING WHEREAS, Division 1.3 of the Fort Collins Land Use Code (the "Land Use Code") establishes the Zoning Map and Zone Districts of the City; and WHEREAS, Division 2.9 of the Land Use Code establishes procedures and criteria for reviewing the rezoning of land; and WHEREAS, in accordance with the foregoing, the Council has considered the rezoning of the property which is the subject of this ordinance, and has determined that the said property should be rezoned as hereafter provided; and WHEREAS, the Council has further determined that the proposed rezoning is consistent with the City's Comprehensive Plan and/or is warranted by changed conditions within the neighborhood surrounding and including the subject property; and WHEREAS, to the extent applicable, the Council has also analyzed the proposed rezoning against the considerations as established in Section 2.9.4(H)(3) of the Land Use Code. The subject property for the City of Fort Collins Vehicle Storage and Service Maintenance Facility Rezoning is designated as Employment on the City of Fort Collins Structure Plan, an element of the City's Comprehensive Plan. B. The proposed plan amendment will promote the public welfare and will be consistent with the visions, goals, principles and policies of City Plan and the elements thereof. C. The rezoning request is consistent with the existing land use established within the area, particularly the adjacent land to the east and west of the site. RECOMMENDATION Staff recommends that City Council approve the City of Fort Collins Vehicle Storage and Service Maintenance Facility Rezoning #23-03, Amendment to the Zoning Map from POL — Public Open Lands to E —Employment. (2) Whether and the extent to which the pLQWsed amendment would result in significantly adverse impacts on the natural environment, including, but not limited to water, noise, air, stormwater management, wildlife, vegetation wetlands and the natural functioning of the environment. The parcels are currently zoned POL — Public Open Lands. The purpose of this zone district is to include larger, public owned parcels of land which have a community -wide interest to be included within its own zoning. These typically include public parks, natural areas, recreation facilities and golf courses. While the City owns the parcel, it does not meet the criteria for the POL designation. This parcel is not included within the Parks and Recreation Master Plan, nor does the parcel warrant preservation as a natural area or other public open space. The parcel is within 400 feet of the Poudre River. The site itself does not contain any wetlands or other natural habitats which may warrant special preservation, however, future study may be necessary when a project development plan is proposed. (3) Whether and the extent to which the proposed amendment would result in a lotdcal and orderly development pattern. The Employment zone district would allow the continuation of the City's Service Center. This area will be planned as a single development rather than with projects had this parcel be zoned differently. 3. Request for E — Employment District Zoning The applicant initially filed a rezoning petition with the City on July 11, 2003. The current request is to rezone 15.25 acres from POL to E. The property is partially developed with buildings, parking and drive aisles that are a part of the City's Service Center. The purpose of the Employment Zone District is to provide a "locations for a variety of workplaces, including light industrial, research and development activities, office and institutions." Additionally, the Employment District is intended to encourage the development of planned office and business parks; to promote excellence in the design and construction of buildings, outdoor spaces, transportation facilities and streetscapes; to direct the development of workplaces consistent with the vitality and quality of life in adjacent residential neighborhoods. 4. Neighborhood Response: The Current Planning Department has scheduled a neighborhood information meeting for this rezoning on August 26, 2003. This meeting will be held after the publication of the staff report. Staff will foreword notes from this meeting to the Planning and Zoning Board prior to the September 4, 2003 hearing. 2. Ouasi-Judicial Rezoning_ The properties included within the rezoning petition are less than 640 acre. Therefore, the rezoning is considered a quasi-judicial rezoning. In order for the Planning and Zoning Board to recommend approval of a rezoning to the City Council, the following criteria must be met: A. Consistent with the City's Comprehensive Plan: The requested Employment zoning is consistent with the City's Structure Plan, which is an element of the Comprehensive Plan. The Structure Plan represents this parcel as Employment. and/or B. Warranted by change in the neighborhood surrounding and including the subject property The area to the east and west of the site has been developing as part of the City of Fort Collins Service Center. City Utilities, including electric, stormwater, water and wastewater and their associated equipment is located east of the site. Operation Services has a Fleet Maintenance building at the northern portion of the site, and a vehicle repair building just west of the site. The proposed rezone will facilitate the location of additional services necessary for the City to provide service to the public. The expansion of the Service Center will centralize additional functions are currently distributed throughout the City. C. Additional Consideration for Quasi -Judicial Rezonings: In determining whether to recommend approval of any such proposed zoning amendment, the Planning and Zoning Board and City Council may consider the following additional factors: (1) Whether and the extent to which the pro2gsed amendment is compatible with existing and proposed uses surrounding the subject land, and is the appropriate zone district for the land: The area adjacent to the site has developed with similar uses permitted in the Employment District. east of I-25 has a rural character and density. Much of the land is used for farming. The Urban Estate provides one of the lowest maximum densities of the City zone districts, a maximum of two units/acre. The land to the east of the site is zoned FA 1 in Larimer County, which would permit a residential density less than that of Urban Estate. The proposed UE zoning will provide greater compatibility with the area than the existing Industrial zoning. AGENDA ITEM SUMMARY I ITEM NUMBER: 21 DATE: October 7, 2003 FORT COLLINS CITY COUNCIL FROM: Bob Barkeen SUBJECT: First Reading of Ordinance No. 138, 2003, Amending the Zoning Map of the City of Fort Collins by Amending the Zoning Classification for that Certain Property Known as the City of Fort Collins Vehicle Storage and Operations Service Maintenance Facility Rezoning. RECOMMENDATION: Staff and the Planning and Zoning Board recommend adoption of the Ordinance on First Reading. This rezoning was adopted unanimously by the Planning and Zoning Board on September 4, 2003, by adoption of its Consent Agenda. EXECUTIVE SUMMARY: This is a request to rezone three parcels of land at the northwest comer of Vine Drive and Wood Street, just west of the existing City of Fort Collins Service Center. The property is currently zoned POL — Public Open Lands and would be rezoned to E — Employment. A total of 15.25 acres of land is included within the rezone requested. The parcel is designated as E — Employment on the City of Fort Collins Structure Plan. The site contains the City's Fleet Service Building and is also used for material storage. The rezone will facilitate the expansion of the Fort Collins Service Center. The rezoning request is consistent with the City of Fort Collins Structure Plan. This plan represents the land north of Vine Drive, 1/4 mile east of Shields Street for Employment uses. This designation includes the existing Service Center site. FINDINGS and ANALYSIS 1.
