Ir� the event such abstacles are instvlled in the Easem�nts, the City nas the rigi�t to require the �wner ta remove such obstacles f rom the Easements. If Owner daes not remove �uch obstacles, the �ity may remov� such abstacles without any liability or obligatic�n for repvir and replacement thereaf, and charge the t�wner the �ity'� �asts far such rema�ral. If the City chaos�s not to rernove the obstacles, the City will r�ot be liable for any dar�age ta the abstacles or any other prap�rty to w�rich they are attached. The rights granted ta the City by this Plat inure to the �enefit of the City's ag�nts, licensees, permittees and assigns �� ���. . . The ��rr�er hereby avarrants and guarantees to the City, far a period of two (2� years frc�rn the date af campletion and first acc�ptance by the City afi the irnpravements warranted l�ereunder, the full and complete maintenance and repvir af the improvements to be constructed in conr�ectiorr with the Develc�pment which is the subject of this Plat. This warranty and guarantee is made in accordance with the City L�nd t�se Code and/or the Transitianal Land U�e Regulations, as applicable. This guarantee vpplies to the streets and all other appurten�nt structures and amenities lying within the rights��f-way, Easement� �nd other public properties, including, without lirnitation, all curbing, sidewalks, bike paths, drainage pipes, culverts, catch basins, drainage ditche� ond ic�nd�caping. Any maintenanc� and�or repair required on utilities shall be coordinated with the ownir�g utility carnpany ar depa rtment. The Owner shall r�naintain said irnprovements in a manner that will assure compliance an a consistent basis with all construction standards, safety requirements and er�vironrnental protection requirements of the City. The �wner shall als� correct and repc�ir, or caus� tc� be cc�rrected and repaired, all dam�ages to �aid irnprovements resulting frorn development-related or building-rel�ted a�tivities. In the event the t�wner fails to correct any damages within thirty {3+�� days after written notice thereof, then said damages mfly be corrected by the City and all costs a�nd charges billed to and paid by the �wner. The �it�r shvll alsa have any ather remedies available to it as au�horized by I�aw. Any damages �rhich occurred prior to the end of said two {2} year period and r�hich are unrepaired at th� termination of said periad �hall remain th� respansibility c�f the Own�r. Further, the awner warrants that he%she owr�s fe� simple title to th� pro�erty shown her�or� and agrees that the Cit�y shall not be liable to the C�wner ar his/her successor�s in interest during the warrvnty periad, for any �IaMm af damages resulting from negligence in exercising engineering techniques and due cautivn in the construction of cross drains, drives, stru�tc�res or buildings, the �hanging af c�urse� of strec�ms and river�s, flaoding from natural creeks and rivers, and any other mvtter whatsaev�r on private property.
