There shall be no private conditions, covenants or restrictions that prohibit or limit the installation of resource conserving equipment or landscaping that are allowed by Sections 12- 120—12-122 of the City Code. 2. The Development Agreement and all Amendment Agreements for Poudre Valley Health System Harmony Campus Medical Center Second Filing shall continue to apply to the lot created by this plat. A portion of the emergency access and access easement needs to be dedicated as a utility easement (where the water main runs in the driveway) and a portion needs to be dedicated as drainage easement (where the drainage pipe crosses the driveway). The SE corner of the plat also needs to be a drainage area. This is where the wet well is located and the drainage off the end of the driveway goes across. The area to the south — the plat identifies that an off -site emergency access and access easement needs to be dedicated by separate document. Per the 3rd Filing plat this area is already an access easement so it only needs to be an emergency access easement that is dedicated. The Harmony Road sidewalk crosses over the cable television easement and the exclusive easement for the Harmony Transmission Main. Access easement for this sidewalk needs to be dedicated across these easements where it has been built to maintain public access. Because the FCLWD easement is an exclusive easement they will need to sign the plat accepting the access easement where it crosses their easement. Utility plans Sheet 004 identifies the land to the east of this site as an existing drainage and grading easement. How was this dedicated as it was not dedicated by the prior plats? Sheet 008. This sheet is missing a signature block. Need to show the perforated pipe that will be under the pavers on the utility plan sheet and/or of the grading plans sheet. Where do they run and where do they outfall to? The utility plans note generally where the transformer will be located, but do not show the concrete pad that will need to be installed for this. Furthermore. the City of Foil Collins Transfort requires a transit and access casement be provided liar the bus stop. which will require this casement be provided by separate legal and exhibit, upon rek-icw and approval by the ditch company and the City. this letter of intent serves as record of the design effort and communication produced to date, with a formal ilgrecmcttt between LICIT and the Warren Lake Reservoir Company to follow at a later lime. but prior to completion and acceptance of the project through the City's entitlement process. 4� Please confirm by your signature that based on design methodology and exhibits presented to the ditch company to date, the proposed bus stop location and associated easements appear to he acceptable, but will require final review and approval, and possibly modification, at the discretion of the ditch company.
