TO WHOM IT MAY CONCERN: The City Engineer's office has recently been informed that construction has started on the Skyline Mobile Park P.U.D. The intent of this letter is to serve notice that all work related to the above named Planned Unit Development is to stop immediately. No future construction is to take place until such time as the applicable permits, fees and general requirements have been addressed. Please be informed your firm is in violation of Chapter 76-2 Mobile Homes (Construction permit), 99-1 thru 7 (Subdivision of land) and the Development Agreement dated May 19, 1983 signed by your partnership and the City of Fort Collins. Also, be aware that these violations are subject to Chapter 1-23 General Penalty for Violations which state in part..."shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine not exceeding three hundred dollars ($300.00) or by imprisonment not exceeding ninety (90) days, or by both such fine and imprisonment;..." For your information, please find enclosed copies of the applicable provisions of the Code of the City of Fort Collins. Please also consider it the receipt for the following enumeration of City fees. City Engineer TEH/slh $129,384.40 to obtain another Mobile start construction on CITY OF FORT COLLINS MEMORANDUM DATE: August 24, 1983 TO: Dave Stringer, Chief Construction Inspector`s FROM: Rodney Albers, Construction Inspector t RE: Orchard Place Pedestrian Path jt In response to your inquiry of the status of the asphalt bike/pedestrian pathway at Skyline Mobile Home Park/Ponderosa Park P.U.D., I am recapping the events that have taken place to date. On Wednesday, August 17, 1983, Spike Hoffman, developer of Skyline Mobile Park, met with me at his site. He informed me as to his intentions and schedule for the installation of the 8" water main parallel to the Orchard Place pedestrian path. This main is required for fire protection of his development. At this time, Spike informed me that the main "tie-in" would be made on Saturday, August 20, 1983. He also voiced his concern in regard to the opening of school on Wednesday, August 24, 1983. Spike wanted to be sure to have this work completed to assure that he would not cause any inconvenience or hazards to the students using this pathway. On Friday, August 19, 1983, I again met with Spike Hoffman at the site. At this time, we checked the operation of the 8" and 6" water main gate valves to verify that the main could be shut down for his scheduled "tie-in". We found both to be operable. He worked until approximately 8:00 p.m. this night excavating to expose the existing utilities (i.e. L&P, Mt. Bell, PSCO) in order to avoid any possible delays with his construction on the following day. At this time, he also notified the affected property owners of his schedule. Also, the 6' chain link fence along the north side of the path was razed this date for construction access and the proposed fire access ' lane. On Saturday, August 20, 1983, construction of the new water main started at 7:00 a.m. and work was stopped at approximately 7:30 p.m. During this time, Spike Hoffman had the path barricaded and signed as "Temporarily Closed". All work, with the exception of the end of the new water main, was backfilled at the end of the day. The open excavation was properly barricaded. On Monday, August 22, 1983, the water main pipeline installation was completed with the exception of the required concrete thrust blocks. Again, the excavation was backfilled at the close of the day's work. Spike Hoffman informed me that he worked until dark (8:30 p.m.) in order to assure completion prior to school on Wednesday. ;. -2- On Tuesday, August 23, 1983, the water main was exposed at the required thrust block locations (i.e. directly under the pedestrian path near his S.W. property corner) and the thrust blocks were constructed. Also, this date, the 6' fence along his property line was reinstalled and gravel was placed in the path where the asphalt was removed for the water main construction. Spike Hoffman informed me that the path would be in good repair and in safe condition for the students' use on Wednesday morning. The fence posts for the 6' fence along the north side of the fire access road through Ponderosa Park P.U.D. were also installed along with the gravel base for the fire access road which is immediately north and adjacent to the pedestrian path. At this time I observed the path to be in a safe condition for pedestrian use. The path had been broomed of any loose debris and the excavated asphalt had been temporarily replaced with gravel. Spike Hoffman informed me that he would replace the asphalt on Wednesday, August 24, 1983, but that he would not start until school was in progress and all the students had passed through the site. On Wednesday, August 24, 1983, you expressed concern to me that complaints regarding the condition of the path had been received. I therefore visited the site at approximately 10:00 a.m. and found Spike Hoffman in progress of replacing the previously removed asphalt. At this time Spike Hoffman informed me that he was trying to complete the asphalt installation prior to 12:00 p.m. because that was when the lunch and kindergarten traffic would be passing through the site. He also informed me of his intention to place plywood boards over the new asphalt in order to avoid having the children track asphalt tar on their shoes and their homes. He also said he would have the 6' fence through Ponderosa Park P.U.D. erected at the close of the day. I feel that the Skyline Mobile Park developer has demonstrated good and reasonable intentions with regard to the pedestrian path access throughout the construction period. Any inconveniences to the users were given top priority and if any have existed they were most likely unavoidable. For your information, the following work is planned and remains to be completed. A 20-foot by 6-foot chain link fence gate across the fire access road at Skyline's S.W. property corner. This will allow for emergency access without disrupting the purpose of the fence along the path. Break -away posts at the end of Ochard Place across the path and the fire access road. This will prevent vehicular access onto the path and fire road. Access gate for the path to be reinstalled at Skyline's S.W. property corner. This gate was originally at the end of Orchard Place. Krempel, Director of Public Works & Water Utilities RE: Orchard Place Pedestrian Path L, John, attached is a report on the excavation across the Orchard Place Bike Path. Because it is probably more than you wanted to know, I have high- lighted it in a few places and provided this recap. It was private construction by Hoffman, owner of Skyline Mobile Home. - He was aware of school starting on the 24th and attempted to accommodate that. - When he failed to complete on time he did work until dark to make it safe. - He also attempted to accommodate the foot traffic during the paving operation on Wednesday the 24th. The City has no problem with your granting Mountain Bell an easement in the loca- tion of an emergency access easement at the south end of Skyline Mobile Home Park PUD. We only ask that the surface be replaced in a timely manner should Mountain Bell need to cut it. Mul Fort Collins, Dear Mr. Ho The staff has reviewed the plans for any unresolved issues or incomplete requirements regarding the Skyline Mobile Home Park P.U.D There are two issues that do not appear to have ee y satrs ie a is time. They are as follows: a. According to the Development Agreement dated May 19, 1983, the developer of the property agreed to participate in a future Street Improvement District for the improvement of Orchard Street when it is extended in the future. The developer's responsibility is that portion of Orchard Street that traverses the subject property. The subject street is located in the southwest corner of the site. This street has not yet been extended nor has a Special Improvement District been formed for this improvement. Therefore, the developer's commitment is still in effect and will need to be fullfilled when the street is eventually extended. b. In reviewing the approved site plan for the project and upon field inspection of the site, there are some shrub, evergreen and tree plantings that have not been installed along the west property line and along the frontage of Mulberry Street. According to our records, all other commitments made as part of the PUD approval appear to have been met. A discussion of remaining storm drainage issues, if any, will be forwarded to you from the City's Storm Drainage Utility.
