There is an existing 20' utility easement and the applicant would like to vacate 10' of that. There would still be a 10' utility easement from the property line that would accommodate the existing utilities. Please see the attached sketches showing the existing lot, easements, and utility placement to determine if you have an objection or concern to the proposed vacation. Please sign and return any comments to Susan Joy in the Development Review Department by March 10, 2006. Professional real estate development, management and brokerage services February 13, 2006 Mr. Marc Virata City of Fort Collins, Civil Engineer II 281 North College Ave Fort Collins, CO 80521 Re: Lot 2, New Hampshire Subdivision - Request to vacate utility easement Dear Mr. Virata: Currently, there exists a 20' wide utility easement across the easternmost portion of Lot 2, New Hampshire Subdivision that was included on the original Plat of the New Hampshire Subdivision back in 1980. The attached drawing reflects the location of this existing utility easement. This easement is wider than necessary to accommodate anticipated utilities and wider than normally required under current standards. The extra width of the existing easement conflicts with the desired location of building envelopes on the property as now being proposed. Given these circumstances, we respectfully request that this utility easement be narrowed to ten feet (10') in width and that the westernmost 10' of the existing easement be vacated as illustrated on the attached drawing. Based upon physical locates of utilities completed last week, there are no existing utilities installed that would be negatively impacted by the vacation of easement as proposed. If the proposed easement vacation is acceptable, a complete legal description will be prepared by a licen surveyor for inclusion with the final documentation.
