HomeMy WebLinkAboutTHUNDERBIRD ESTATES NINTH - Filed RV-ROW VACATION - 2003-02-28P!1?1188 P008?_8 I1,553 itrL.1,--v r tw.11 1 ''ll LAR ^R 198I Jl'.`! -5 P1 I' 37 S T A T E QF CCLI_C'R.A.SC ORDINANCE NO. 74 , 1981 OF THE COUNCIL OF THE CITT—OF FORT COLLINS BEING AN ORDINANCE VACATING A PORTION OF SOUTH COLLEGE AVENUE ACCESS ROAD AND A PORTION OF DEL CLAIR ROAD IN THE CITY OF FORT COLLINS WHEREAS, the City Council has been petitioned to vacate a portion of South College Avenue access road and a portion of Del Clair Road, said sections being more particularly set out below; and WHEREAS, said portions of said roadways are not presently needed; and WHEREAS, the rights of the residents of the City of Fort Collins will in no way be prejudiced or injured by the vacation of said portions of roadways provided that there is reserved unto the City an access easement in form satisfactory to the City of Fort Collins. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS. Section 1. That those certain roadways, more particularly described as follows, to -wit: A portion of Thunderbird Estates Ninth Subdivision, Fort Collins, Colorado, which is contained within the boundary lines that begin at a point which bears N 89047'08" E 50.00 feet, and again N 00°00'45" W 195.00 feet from the West 1/4 corner of Section 25, Township 7 North, Range 69 West of the Sixth P.M., and run thence N 00000'45" W 508.06 feet; thence East 30.00 feet; thence N 00°00'45" W 58.00 feet; thence along the arc of a 15 foot radius curve to the left a distance of 23.56 feet, the long chord of which curve bears S 45°00'22" E 21.21 feet; thence East 204.60 feet; thence along the arc of a 15 foot radius curve to the left a distance of 23.56 feet, the long chord of which curve bears N 45°00' E 21.21 feet; thence South 90.00 feet; thence along the arc of a 15 foot radius curve to the left a distance of 23.56 feet, the long chord of which curve bears N 45°00' W 21.21 feet; thence W 204.59 feet; thence along the arc of a 15 foot radius curve to the left a distance of 23.57 feet, the long chord of which curve bears S 44°59'38" W 21.21 feet; thence S 00°00'45" E 460.89 feet; thence along the arc of a 15 foot radius curve to the left a distance of 23.62 feet, the long chord of which curve bears S 45°06'52" E 21.25 feet; thence S 89° 47' W 45.06 feet to the point of beginning. That two access easements more particularly described as follows, to -wit: Easement No. 1: n easement 14 feet in width for public and emergency access, the centerline of which is more particularly described as beginning at a point which bears N 89*47' 08" E 50.00 feet, and again N 00°00'45" W 195.00 feet, and again N 89°47' E 14.00 feet from the West 1/4 corner of Section 25, Township 7 North, Range 69 West of the Sixth P.M., Fort Collins, Colorado, and run thence N 00°00'45" W 391.00 feet; thence along the arc of a 74.99 foot radius curve to the right a distance of 15.94 feet, the long chord of which curve bears N 06004'37" E 15.91 feet; thence N 12°10' E 15.61 feet; thence along the arc of an 89.65 foot radius curve to the left a distance of 19.06 feet, the long chord of which curve bears N 06°04'38" E 19.02 feet; thence N 00°00'45" W 67.00 feet to a point on the Southerly boundary of an existing public access road. Easement No. 2: n easement 26 feet in width for public and emergency access the centerline of which is more particularly described as begining at a point which bears N 89°47' 08" E 50.00 feet, and again N 00*00' 45" W 703.06 feet, and again East 30.00 feet, and again N 00°00'45" W 13.00 feet from the West 1/4 corner of Section 25, Township 7 North, Range 69 West of the Sixth P.M., Fort Collins, Colorado, and run thence East 234.60 feet, more or less, to a point on the Westerly right of way line of Remington Street. be, and the same hereby are, reserved unto the City of Fort Collins. Section 3. That in consideration for vacation of portions of said roadways, Everitt Enterprises agrees to complete all improvements to said vacated property as set forth in the site plan on file in the Planning Department, and subject to further modifications deemed appropriate by the City of Fort Collins. -2- Introduced, considered favorably on lished this 19th day of May, A.D. 1981, passage on the 2nd day of June, A.D. 1981.
