RCPTN # 94021976 03/11/94 11:22:00 # PAGES - 1 FEE - $5.00 M RODENSERGER RECGRDEP, LARIMER COUNTY Cv STATE DOC FEE - $.GO ORDINANCE NO. 18, 1994 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING AN EASEMENT FOR UTILITIES BETWEEN LOTS 17 AND 18 RESERVED ON THE PLAT OF SOUTH COLLEGE HEIGHTS FIRST SUBDIVISION WHEREAS, the plat of South College Heights First Subdivision reserved a 10' easement for utilities between Lots 17 and 18; and WHEREAS, this easement was never used for utilities and a house has been built over this easement area; and WHEREAS, pertinent City agencies and private utility companies have been contacted and report no objection to the proposed vacation of easement; and WHEREAS, there will be no cost to the City in making the proposed vacation; and WHEREAS, the rights of the residents of the City of Fort Collins will not be prejudiced or injured by the vacation of said easement. NOW, THERE -FORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the easement for utilities between Lots 17 and 18 reserved on the plat of South College Heights First Subdivision be and same hereby is, vacated, abated and abolished. ATTEST: 1 City Clerk B 7 2 8 2 P 0 0 6 3 57MA 104.JUL ?I+ 1PM'2V0 COUNTY 0F*1_'AP.fM7R ST,;TE OF'COLORA,DO ORDINANCE NO. 78 , 1984 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING A PORTION OF A UTILITY EASEMENT IN SOUTH COLLEGE HEIGHTS FIRST FILING WHEREAS, the Council of the City of Fort Collins has been petitioned to vacate a portion of a utility easement located between Lots 1 and 2, Block 1, South College Heights First Filing set forth in more particular below; and WHEREAS, this vacation would enable the petitioner to construct a two car garage adjacent to his house; and WHEREAS, there are no utilities located in the easement and all utilities indicate no problem with the vacation request; and WHEREAS, the rights of the residents of the City of Fort Collins will in no way be prejudiced or injured by said vacation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that that portion of a certain utility easement located between Lots 1 and 2, South College Heights First Filing, set out more particularly as follows, to wit: All of the 10' utility easement centered on the proper- ty line between Lots 1 and 2, Block 1, South College Heights First Filing, Fort Collins, Larimer County, Colorado, EXCEPT the North 10' be, and the same hereby is, vacated, abated and abolished. Introduced, considered favorably on first reading, and ordered pub- lished this 3rd day of July, A.D. 1984, and to be presented for final passage on the 17thday of July A.D. 1984.
