ORDINANCE NO. 115, 1985
OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A PORTION OF AN ACCESS AND UTILITY EASEMENT
AT RIVERSIDE SHOPPING CENTER, FILING II
WHEREAS, the Council of the City of Fort Collins has been petitioned to
vacate portions of an access and utility easement located at Riverside
Shopping Center, Filing II, set forth in more particular below; and
WHEREAS, this vacation is needed to complete the realignment of the
access for Riverside Shopping Center, Filing 1; and
WHEREAS, a new easement has been accepted by the Council to compensate
for the portion vacated in this Ordinance; and
WHEREAS, all utilities have been contacted and indicate no problems
with the vacation request; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that that certain portion of an access and utility easement located
at Riverside Shopping Center, Filing I1, set out more particularly as
follows, to wit:
A tract of band, located in the Northeast Quarter of Section 13,
Township 7 North, Range 69 West of the Sixth P.M., City of Fort
Collins, County of Larimer, State of Colorado, being more
particularly described as follows:
Considering the East line of the said Northeast Quarter as bearing
N 00025' E and with all bearings contained herein, relative
thereto:
Beginning at the East 1/4 Corner of said Section 13; thence N
00025' E 350.00 feet; thence N 89°24'24" W 183.92 feet said point
being the true Point of Beginning.
Thence N 89°24'24" W 30.00 feet; thence N 00°35'36" E 117.02 feet;
thence N 89°24'24" W 10.00 feet; thence N 00°35'36" E 120.00 feet;
thence S 89"24'24" E 30.00 feet; thence S 00°35'36" W 60.00 feet;
thence S 89"24'24" E 10.00 feet; thence S 00°35'36" W 177.02 feet
to the Point of Beginning.
The above described tract contains 0.177 acres, more or less.
be, and the same hereby is, vacated, abated and abolished.
Introduced, considered favorably on first reading, and ordered
published this Ist day of October, A.D. 1985 and to be presented for final
passage on the 15th day of October, A.D. 1985.
