ORDINANCE No. 93 , 1978
BEING AN ORDINANCE VACATING A UTILITY EASEMENT IN THE
LANDINGS, FIRST FILING.
WHEREAS, there was dedicated for public purposes to the
City of Fort Collins a ten (10) foot utility easement in the
Landings, First Filing; and
WHEREAS, the northern four (4) feet of such easement is
not needed for municipal purposes nor will the same be needed for
municipal purposes in the future; and
WHEREAS, the owners of the property across which the easement
is located have requested that the City of Fort Collins vacate
the northern four (4) feet of said easement.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF FORT COLLINS that the following, to -wit:
The northern four (4) feet of the ten (10)
foot utility easement at the rear of Lots 50,
51, 52, 53, 54, 55, 56, 57, 58, 59, 60, 61,
62, 63, 64, 65, 66, 67, 68, and 69 and
Tracts D, H, I, J, K, and L, of the First
Replat of the Landings, First Filing, in the
City of Fort Collins, Colorado,
be, and the same hereby is, abated, vacated and abolished.
Introduced, considered favorably on first reading, and
ordered published this 19th day of September A.D. 1978, and
to be presented for final passage on the 3rd day of October,
A.D. 1978.

ORDINANCE NO. 43, 1979
BEING AN ORDINANCE VACATING A PORTION
OF A UTILITY EASEMENT ON LOT 44, REPLAT OF
THE LANDINGS FIRST FILING, CITY OF FORT COLLINS,
COUNTY OF LARIMER, STATE OF COLORADO
WHEREAS, as the result of a surveying error, construction was inad-
vertently permitted to occur over a dedicated ten -foot utility easement;
and
WHEREAS, no utilities are located in the said easement; and
WHEREAS, satisfactory alternate locations exist for the placement of
utilities.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the 10 foot wide utility easement on Lot 44, First Replat of
the Landings First Filing, commonly known as 3718 Mariner Lane, City of
Fort Collins as indicated on Exhibit "A" attached hereto be, and the same
hereby is, vacated. (Note: Exhibit "A" is on file City Clerk's office)

VACATING A UTILITY EASEMENT LOCATED WITHIN LOT 33,
THE FIRST REPLAT OF THE LANDINGS, FIRST FILING
WHEREAS, the City Council has been petitioned to vacate a portion of a
6.4' utility easement located within Lot 33, the First Replat of The
Landings, First Filing, more particularly described below; and
WHEREAS, the said portion of the utility easement is not presently
needed; and
WHEREAS, it appears that the rights of the residents of the City of
Fort Collins will in no way be prejudiced or injured by the vacation of
said utility easement.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the following utility easement, more particularly described,
as follows, to -wit:
A tract of land situate in Lot 33, the first replat of
Landings, First Filing, County of Larimer, State of
Colorado, which considering the west property line of
said Lot 33 as bearing South 00*18' east and with all
bearings contained herein relative thereto, is more
particularly described as follows: Begin at a point
which bears South 89*42' East 6.0 feet; and again North
00*18' West 39.1 feet from the Southwest corner of said
Lot. 33 and run thence South 89042' West 3 feet; thence
North 00018' West 4.0 feet; thence North 89*42' East 3
feet; thence South 00*18' East 4.0 feet to the point of
beginning, containing 12 square feet more or less;

OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING A PORTION OF THE REAR LOT UTILITY EASEMENT
DEDICATED ON LOT 62 OF THE FIRST REPLAT
OF THE LANDINGS FIRST FILING
WHEREAS, Section 2-353 (4) of the Code of the City of Fort
Collins authorizes the Planning and Zoning Board to vacate certain
rights -of -way, by resolution or by approval of replats containing
notation of such vacation; and
WHEREAS, the Owner of Lot 62 of the First Replat of the
Landings, First Filing has requested that the City vacate a portion
of the 10 foot wide rear lot utility easement dedicated on said lot
and more particularly described on Exhibit "A" attached hereto and
incorporated herewith by this reference; and
WHEREAS, the vacation request has been reviewed and approved
by the pertinent City and private utilities, and they report no
objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning
Board of the City of Fort Collins, that the portion of the 10 foot
wide utility easement dedicated on Lot 62 of the First Replat of
the Landings, First Filing, more particularly described on Exhibit
"A", attached hereto and incorporated herewith by this reference,
be and is hereby vacated.
Passed and adopted at a regular meeting of the Planning and
Zoning Board of the City of Fort Collins held this 27th day of
June, A.D. 1994.
