PZ97-5 OF THE PLANNING AND ZONING BOARD OF THE CITY OF FORT COLLINS VACATING A PORTION OF THE BLANKET EASEMENT WHICH IS DEDICATED AS A UTILITY, ACCESS, AND DRAINAGE EASEMENT DRAKE CROSSING SHOPPING CENTER WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the Planning and Zoning Board to vacate certain easements, by resolution or by approval of replats containing notation of such vacation; and WHEREAS, the Owner of the Drake Crossing Shopping Center has requested that the City vacate a portion of the blanket easement which is dedicated as a utility, drainage, and access easernent in the Drake Crossing Shopping Center and more particularly described below; and WHEREAS, the vacation request has been reviewed and approved by the pertinent City and private utilities, and they report no objections. NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City of Fort Collins, that a portion of the blanket easement which is dedicated as a utility, drainage, and access easement in the Drake Crossing Shopping Center more particularly described as follows to wit: A part of the Drake Crossing Shopping Center (as recorded in Book 2167 at Page 709 in the records of the Larimer County Clerk), City of Fort Collins, County of Larimer, State of Colorado, which is contained within the boundary lines which begin at a point which bears S 88044'09" W 40.00 feet, and again N 00009'00" E 23.50 feet from the Southwest corner of Tract A of said Drake Crossing Shopping Center and run thence N 89051'00" W 81.00 feet; thence N 00009'00" E 40.00 feet; thence S 89051'00" E 81.00 feet; thence S 00009'00" W 40.00 feet to the point of beginning. be and is hereby vacated. Passed and adopted at a regular meeting of the Planning and Zoning Board of the City of Fort Collins held this 21st day of August A.D. 1997. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that that certain portion of an access, utility and drainage easement located at Drake Crossing Shopping Center PUD, set out in more particular as follows, to wit: A portion of the access, utility and drainage easement at the Drake Crossing Shopping Center, a Planned Unit Development, City of Fort Collins, Colorado, as recorded with the Clerk and Re- corder of Larimer County, Colorado, being described as follows: Beginning at the Southeast corner of the Southeast Quarter of Section 21, Township 7 North, Range 69 West of the Sixth Princi- pal Meridian, and considering the Southerly line of said South- east Quarter to bear South 88°44'09" West, with all bearings contained herein relative thereto; thence Westerly along said Southerly line, South 88 44 09 West 426.89 feet; thence de- parting said Southerly line, North 01°15'51" West 50.00 feet to the Northerly right-of-way line of Drake Road and the South- westerly corner of Tract "C" of said Drake Crossing Shopping Center P..U.D.; thence Northerly along the Westerly line of said Tract "C" along a non -tangent curve to the right having a delta of 91°24'51", a radius of 14.50 feet, an arc of 23.13 feet, and a long chord which bears North 45°33'42" West 20.76 feet; thence North 00"09'00" East 93.99 feet; thence along a curve to the right having a delta of 88 33 49 , a radius of 14.50 feet, an arc of 22.41 feet, and a long chord which bears North 44025'46" East 20.25 feet; thence departing said Westerly line, North 00°35'16" East 72.84 feet to the True Point of Beginning of this descrip- tion; thence North 45000'00" West 15.00 feet; thence North 45°00'00" East 20.50 feet; thence South 45000'00" 15.00 feet; thence South 45000'00" West 20.50 feet to the point of beginning of this description.
