WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
Planning and Zoning Board to vacate certain rights -of -way, by resolution or by approval
of replats containing notation of such vacation; and
w WHEREAS, the Owner of Lot 1 of the Center Point Park #3 has requested that the
w w City vacate portions of the 30 (thirty) foot utility easement dedicated on Lot 1 of the Center
rw Point Park #3 and more particularly described below; and

Q WHEREAS, the vacation request has been reviewed and approved by the pertinent
w City and private utilities, and they report no objections.

w U) NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City
of Fort Collins, that two portions of the 30 (thirty) foot utility easement dedicated on Lot 1
