CLAIR F. WOLY92 ANNEXATION TO THE CITY OF FORT COL.LINS,
COL.ORADO, AND AVMRIZING THE ANNEXATION OF ALL THE
TERRITORY EMBRACED IN SAID PLAT TO THE CITY OF FORT
COLLINS, TNESAME To BE MADE A PART OF THE CITY OF FORT
COLLINs AND To BE INCLUDED WITHIN TRt LIMITS AND JURIS-
DICTION THEREOF, PURSUANT To TNA AUTNDRITY CONTAINED IN
ARTICLE 11 CHAPTER 139 COLORADO REVISED STATUES 1.953._
WHEREAS, heretofore a written petition has been presented to
the Council of the City of Fort Collins in substantial compliance with
the provisions of Article 119 Chapter 139, Colorado Revised Statues
1953, by the sole owner of the land embraced in what is known as the
Clair F. Wolfer Annexation to the City of Fort Collins- Wherein and
whereby said petitioner and applicant petitioned the City of Fort Calling
for the &uexation to the City of Fort Collins of all the territory em-
braced in what is known as the Clair F. Wolfer Ann"Wou to the City
of Fort Collins, Colorado, comprising the leads shown in the plat
thereof attached to said petition and more particularly described as
hereinafter set forth.
WNEREAs, &aid petition wag accepted by the Council of the City
of Fort Collins by resolution passed and adopted on the 27th day of
December. A. D. 19361 and
WHEREAS, notice for hearing on the Lbth day of February, &. >.
19311, on an ordinance approving the ann"ation of said territory and in-
cluding the saw within the limits and jurisdiction of the City of Fort
Collies was duly published as provided by law, and
WBERSAS, the Council of the City of Fort Collins has found that
the petition and the documents attached thereto w4he requirements of
Article 11, Chapter 139, Colorado Revised statutes 1953, and
WHEREAS, no proceedings for an election to determine the ques-
tion of summation have been initiated by written counter -petition as
provided by law aed no objection to annexation having been made.
It IT ORDAINED g7 THE COUNCIL OF THE CITY OF FORT COLLUS:
Section 1. That after due consideration of the petition for annexa-
tion that the petition for the annexation of all the territory in what U
known and described as the Clair F. Wolfer Annexation to the City of Fort:
Collins, Colorado, as shown by the plat thereof annexed to said petition
and which is sore particularly described sa follows, to -wit:
Aigportion of the 8g% of the un of Section 15, Township 7 North,
Santa 69 West of the 6th PA., contained within boundary lines beginning at'
a point on the East line of the RA of said Section and 10438 feet South
of ,the NR coiner thereof and running thence South 117.6 feet, more or less„
along the nest line of the NE} of said Section, to a point 1,093 feet
North of the SE corner of the Ng> of said Section, thence West 710 feet,
thence North 117.6 feet, more or less, to a point directly West of the
point of beginning, and thence East 710 feet to the point of beginning,
subject to the right-of-way for the County Road over and across the
Easterly 30 feet thereof -
be accepted and approved and that the said territory be annexed and made
a part of the City of Fort Collins and be included within the limits and
Jurisdiction thereof and that the City Clark be and he is hereby authori-
sed and directed to prepare certified copies of this ordinance, to each
of which shell be attached a plat of said Clair F. Wolfer Annexation to
the City of Fort Collins, Colorado and shall file one copy thereof in
the office of the Clerk and Recorder of the County of Latimer and another
oopy thereof in the office of the Clerk of the City of Fort Collins, to-
getbar with a certified copy of the said petition and another copy of
said petition and approving ordinance with the Secretary of the State
of Colorado.
Section 2. That in accepting and approving the plat of the
Clair p- Wolfer Annexation to the City of Fort Collins, the City of Fort
Collins doss not ssaume obligations respecting the construction of water
mains, sever lines, gas main*, electric light lines or other services or
utilities with respect to the service of said addition, except as may be
required and provided by the owners of property within the limits of
said addition at their ova *spense and except es say be initiated by the
owners of said property within the limits of said addition in compliance

with the testis mad provisions of Ordinance No. 7. 1921, relating to
local and public bgvovmasats, as amended.
INTWDUCSD, considered favorably on first reading and ordered
published this 16th day of February, A. D. 1937. and to be presented for
final passage on Nash 28. A. D. 1957.
