ACCEPTING A+:_ APPROVING THE PLAT OF WHAT IS h_...WN AS THE
WESTERN ANNEXATION TO THE CITY OF FORT COLLINS, COLORADO,
AND AUTHORIZING THE ANNEXATION OF ALL THE TERRITORY FM —
BRACED IN SAID PLAT TO THE CITY OF FORT COLLINS, THE SANE
y TO BE MADE A PART OF THE CITY OF FORT COLLINS AND TO BE.
YJ INCLUDED WITHIN THE LIMITS AND JURISDICTION THEREOF, PUR—
SUANT TO THE AUTHORITY CONTAINED IN ARTICLE 110 CHAPTER
139, COLORADO REVISED STATUTES 1953,
WHEREAS, heretofore a written petition has been presented to the
Council of the City of Fort Collins in substantial compliance with the
provisions of Article 11, Chapter 139, Colorado Revised Statutes 1953
by 192 persons purporting to be 73,8% of the qualified electors in the
area of the territory involved and further purporting to be the owners
of 67,6% of the area of the land embraced in what is known as the Western
Annexation to the City of Fort Collins, wherein and whereby said petitjont�rr
and applicants petitioned the City of Fort Collins for the annexing of r:lt
the territory embraced in what is known as the Western Annexation to the
City of Fort Collins, Colorado, comprising the lands shown in the plat
thereof attached to said petition and more particularly described as
hereafter set forth, and
WHEREAS, said petition was accepted by the Council of the Cite
of Fort Collins by resolution passed and adopted on the 27th day of
September, A. D. 1956, and
WHEREAS, notice of hearing on the 8th day of November, A. D,
1956, on an ordinance approving the annexation of said territory and
including the same within the limits and jurisdiction of the City of
Fort Collins was duly published as provided by law, and
WHEREAS, the Council of the City of Fort Collins has found
that the petition and the documents attached thereto meet the requirement,
of Article ll, Chapter 139, Colorado Revised Statutes 1953, and
WHEREAS, no proceedings for an election to deterirdne the questi,>;,
of annexation have been initiated by written counter —petition as provide+
law and no ob jeci;_ion t annexation having bn,n made.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS:
Section 1. That after due consideration of the petition for 'carer-+-
tion that the petition for the annexation of all the territory in whcLis i..,
known and described as the Western Annexation to the City of Fort Collin,
i Colorado, as shown by the plat thereof annexed to said petition and whic'i,

is more particularly described as follows, to -wit:
A portion of the North 2 of Section 15, Township 7 North, Rang,, r',
West of the 6th P.M., Larimer County, Colorado, and considering the No;-fr
line of said Section 15 as bearing due East and with all bearings herein
relative thereto, contained within the following described boundary liner,
to -wit:
Beginning at a point on the South line of Birch Street in the
Alvin L. Miller Subdivision, according to the plat filed for record on
April 21, 1952, in Plat Book 6 on Page 47, which point is 990.00 feet
South of the North line of said Section 15 and 1,088.00 feet West of the
East line of said Section 15, and running thence West 232.00 feet, to
the SW corner of said Alvin L. Miller Subdivision, on the centerline of
City Park Avenue, which point is also the SE corner of the Miller
Brothers Second Subdivision, according to the plat filed for record on

be accepted and approved and that the said territory be annexed and made a
part of the City of Fort Collins and be included within the limits and

jurisdiction thereof a-' that the City Clerk be and he authorized and
directed to prepare certified copies of this ordinance, to each of which
shall be attached a plat of said Western Annexation to the City of Fart
Collins, Colorado, and shall file one copy thereof in the office of the
Clerk and Recorder of the County of Larimer and another copy thereof in
the office of the Clerk of the City of Fort Collins, together with a
certified copy of the said petition and another copy of said petition
and approving ordinance with the Secretary of the State of Colorado.
Section 2. That in accepting and approving the plat of the
Western Annexation to the City of Fort Collins, the City of Fort Collins
does not assume obligations respecting the construction of water mains,
sewer lines, gas mains, electric light lines or other services or uti]it o"
with respect to the service of said addition, except as may be required
and provided by the owners of property within the limits of said addition
at their own expense and except as may be initiated by the owners of said
property within the limits of said dddition in compliance with the terms
and provisions of Ordinance No, 7, 1921, relating to local and public im—
provements, as amended.
Introduced, considered favorably on first reading and ordered
published this Sth day of Novembers A. D. 1956, and to be presented for
final passage on December 13, A. D. 1956.
