NOTE: THIS REPRESENTS THE BEST QUALITY IMAGE POSSIBLE TAKEN FROM VERY POOR QUALITY ORIGINALS ORDINANCB NO. 21 , 1955 ACCEPTING AND APPROVING THE PW""67 WHAT IS KNOWN AS THE GRAT STRECEER SUBDIVISION, THE PERSONS SUBDIVISION AND THE JUSTICE PLACE SUBDIVISION, AND AUTHORIZING THE ANNEXATION OF ALL THE TERRITORT EMBRACED IN SAID PLAT TO THE CITZ OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURISDICTION THEREOF PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE 11, CHAPTER 1399 COLO- RADO REVISED STATUTES 1953, AND THE PROVISIONS OF ORDINANCE NO. 14, 1924• WHEREAS, heretofore a written petition has been presented to the Council of the City of Fort Collins in substantial compliance with the provisions of Article 11, Chapter 139, Colorado Revised Statutes 19531 by 46 persons purporting to be the owners of 67.08 percent of the land embraced in what is known as the Gray-Streoksr Subdivision, the Persons Subdivision, and the Justice Place Subdivision, wherein and whereby said petitioners and applicants petitioned the City of Fort Collins for the annexation of ill the territory embraced in what is known as the Gray-Streoker Subdivision, the Porsons Subdivision, and the Justice Place Subdivision to the City of Fort Collins, Colorado, comprising the lands shown in the plat thereof annexed to said petition and more particularly described as follows: A tract of land in the Northwest quarter (NWj) of Section 24, Township 7 North, Range 69 West of the 6th P. M., Lorimar County, Colorado, consisting of the (h ay-Streoker Subdivision, the Person Subdivision and the Justice Place Subdivision and more particularly described as being contained within boundary lines which begin at a point on the North line of said Section 24 which is 66O feet East of the Northwest corner thereof and run thence South 662 feet parallel to the West line of the Northwest quarter (NWs) of, a4d Section 24, thence East 1317 feet, more or less, to a poi`Rj phioh is 30 feet South of the Southeast corner of Lot 8 1f: B1oek 3 of the Gray.Streoker Subdivision, according to'ythe plat of Flinn's Resubdivision of. Block 3 Gray.Streoker Subdivision, dated December 319 1945, thence North 662 feet, to a point on the North line of said Section 24, which is 1317 feet; East of the point of beginning, and thence West 1317 feet to thp.point of beginning; A.� � 1 AND, WHEREAS, in the said appi a on and peti.ti.on the applicants for 4 thorrselves and their grantees covenanted and agreed to and with the City of Fort Collins that upon the acceptance of said application, it is expressly agreed and understood that the applicants and their grantees expressly covenant and agree that they will be bound by and will observe and obey the ordinances in effect at the time of the acceptance of said annexation of the addition respecting the in- stallation and payment for local public improvements and WHEREAS, said petition was accepted by the City Council of the City of Fort Collins by resolution passed and adopted on the.28th day of July, A. D.1955, and WHEREAS, notice for hearing on the 8th day of September, A. D. 1955, on an ordinance approving the annexation of the above described territory and in- riudi.n� th- same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law, and WHEREAS, the Council of the City of Fort Collins has found that the petition and the documents attached thereto most the requirements of Article 11, Chapter 139, Colorado Revised Statutes 19531 and WHEREAS, no proceedings for an election to determine the question of annexation have been initiated by written oounter-petition as provided by law and ro objection to said annexation having been made, BE IT ORDAINED B7 THE COUAOIL OF THg CITT OF FORT COLLINSt :;action 1, That after due consideration of the petition for annexation that the petition for the annexation of all the territory embraced in what is known and described as the Cray -Strecker Subdivision, the Persons Subdivision, and the Justice Place Subdivision to the City of Fort Collins, Colorado, as shown by the nl.at thereof annexed to said petition, be accepted and approved and that the said torritory be annexed and made a part of the City of Fort Collins and be included r thi-n the limits and jurisdiction thereof, and that the City Clerk be and he is 1,nrebr authorized and directed to prepare certified copies of this Ordinance to ci Of ,Thiel shall be attached a plat of said Oray-Strecker Subdivision, the Persons iul;aison, and the Justice Place Subdivision and shall file one copy thereof in -2- the office of the Clerk and Recorder of the County of Larimer, and another copy thereof in the office of the Clerk of the City of Fort Collins' together with a certified copy of the said petition, and another copy of said plat and approving ordinance with the Secretary of. the State of Colorado. Section 2. That in accepting and approving the plat of the G ay«Streoker :ubaivision, the Persons Subdivision, and the Justice Place Subdivision, the City n Fort Collins does not assume any obligations respecting the construction of water mains, sewer lines, gas mains, electric light lines or other services or utilities with respect to the service of said addition except as may be required ana provided by the owners of property within the limits of said addition at their cwn expense and except as may be initiated by the owners of property within the limits of said addition in compliance with the terms and provisions of Ordinance too.
