MILLER BROTHERS NINTH FOOTHILLS ANNEXATION TO THE C1TV
OF FORT COLLINS, COLORADO, AND AUTHORIZING THE ANNEXATI`}
OF ALL THE TERRITORY EWBRACED IN SAID FLAT TO THE CITY
OF FORT COLLINS AND TO BE INCLUDED WITHIN TILE LIMITS ANr,
JURISDICTION THEREOF, PURSUANT TO THE AUTHORITY CONTAI14E
IN ARTICLE 11 CHAPTER 139 COW RADO REVISED STATUTES,
WHEREAS, hp+',rcofore a written petition was presented to t4
of the City of Fort Collins in substantial compliance with the provisio.: o'
Article 110 Chapter 139, Colorado Revised Statutes, 1953, by the so1C
of the area of land embraced in what is known as Miller Brothers A4inx:11
Foothills Annexation to the City of Fort Collins, wherein and whereby
said petitioners petitioned the City of Fort Collins for the aunexativ"r
all the territory embraced in what is known as Miller Brothers liinth 1�0oLlIL&.t`
Annexation to the City of Fort Collins* Colorado, comprising the lailiLi 8'x,-
in the plat thereof attached to said petition and more particularly JescriOs
as hereinafter set forth. and
WHEREAS, said petition was accepted by the Council of the city o
Fort Collins by resolution passed end adopted on May 26* 19600 and
WHEREAS, notice for hearing on the 14th day of July, A.D. 1961.
on an ordinance approving the annexation of said territory and lncludin+,> (;L-:
same within the limits and jurisdiction of the City of Fort Collins i= duly
published as provided by law. and
WHEREAS, the Council of the City of Fort Collins has found that r.:.L
petition and the documentstereto attached meet the requirements of Artie",
110, Chapter 1390 Colorado Revised Statutes* 1953, and
WHEREAS* no proceedings for an election to determine the questloo
of annexation have been initiated by written counter -petition es provided, o-j
law and no objection to annexation having been made.
BE IT ORDAINED BY TEE COUNCIL OF THE CITY OF FORT COLLINS:
section 1. That after due consideration of the petition 1:'0a

and which is more particularly described as follows* to -wit:
A tract of land situate in the SA of Section 15,
Township 7 North. Range 69 hest of the 6th P.M.,
County of Lariwr, State of Colorado, which,
considering the WeNt line of said SWh as bearing
N. 00*32' W. and with all bearings contained herein
relative thereto, is contained within the boundary
lines which begin at a point which bears S. 00*32' E.

be accepted and approved and that the said territory be annexed and mada a
part of the City of Fort Collins and be included within the limits and
jurisdiction thereof, and that the following described land, to -wit:
Late 77s 1120 128 through 13S, 145 through 148
of Miller Brothers Ninth Foothills Amexation to
the City of Fort Collins, Colorado, as described
on the proposed annexation plat of said subdivision;
be included in the "B" Residence, District, and that the following land,
to -Vitt
Late 76s and 113 thorough 127 of Millar Brothers Ninth
Foothills Annexation to the City of Fort Collins,
Colorado, ze described on the proposed annexation
plat of said subdivision;
be included as "C" Residence District, and that the City Clark be,
and he is hereby authorized and directed to prepare certified copies of thiW;
ordinance to each of which shall be attached a plat of said Miller Brother4
Ninth Foothills Annexation to the City of Fort Collins, Colorado, and shall
file a copy thereof in the office of the Clark and Recorder of the County
of Lorimar and another copy thereof in the office of the Clark of the City -f
Fort Collins, together with a certified copy of said petition and another
of said petition and approving ordinance with the secretary of State of th-1s
State of Colorado.
Section 2. That in accepting and approving the plat of the miller
Brothers Ninth Foothills Annexation to the City of Fort Collins, the City o.-
Fort Collins does not seems obligations respecting the construction of wateir
mains, sewer lines, gas mains, electric light lines or other services or uGi1s.E_e

with respect to service of said addition, except as may be required and
provided by the owners of property within the limits of said addition ii,
compliance with the terms and provisions of Ordinance tio. 7. 1921, rel=LLl.;,
to local and public improvements as amended.
