WERRRAS, heretofore a written petition was presented to the Council
of the City of Port Collins in substantial compliance with the provisions of
Article 11, Cbspter 139, Colorado Revised Statutes by the sole owners of the
area of land embraced in what is known as fifth South Shields Annexation to
the City of Tort Collins. wherein and whereby said petitioners petitioned the
City of Tort Collins for the annexation of all the territory embraced in
what is known as, Fifth South Shields Annexation to the City of Port Collins,
Colorado, oompri.sin* the lands sbown is the plat thereof attached to said
petition and sore particularly described as hereinafter set forth, and
WERRRAS, said petition was accepted by the Council of the City of
Fort Collins by resolution passed and adopted on Horeb 16, 1961, and
wRzRSAS. notice for hearing on the 27th day of April, A. D. 1961,
on an ordinance approving the ansaratiou of said territory and including the
sane within the liwits and juriadistioa of the City of Fort Collins was duly
publishad as provided by law. end
WERRRAS, the Council of the City of Port Collins has found that
the petition awl the documents thereto attached meet the requirsmsnts of Article
114 Chapter 139, Colorado Revised Statutoso 1953. and
W8911AS, so proceedings for an election to determine the question of
annexation ban been initiated by written cauntar-petition ae provided by law
and so objection to asnexation having been pads,

Section 1. That after duo consideration of the patition for
annenatles, the petition for the snnexation of all the territory in what is
known and described as Fifth South Shields Annexation to the City of Port Collins.
Colorado, se shown by the plat thereof annexed to said petition and which is
more particularly described as follows, to -wits
Soginning At a point which is 163.57 feet forth
of the Southeast corner of the nk of Section 158
Township 7 North, Range 69 West of the 6th P.M.
"A I•wnning thence North 90 feet, thence West 263
foot„ theses South 90 foot, thence Bast 263 foot to
tha `mint of beginning! ALSO, Beginaing at A point
which is 200 foot West and 593.4 feet North from
the Southeast corner of the M 'of Section 15.
Township 7 North, Rang* 69 West of the 6tb Y.M.,
and running thence North 126 feet, thence West 60
feet„ thence South 126 feet, thence Seat 60 foot
to the point of beginning;
be accepted and approved and that said territory be annexed and mado a part of
the City of Tort Collins and.be included within the limits and jurisdiction of
the City of Fort Collins as a part of "C" Residence District, and that the
City Clark be and h* is hereby authorized and directed to prepare certified
copios of this ordin+laoo, to each of which shall be attached a plat of said
Fifth South Shield* Annexation to the City of Fort Collins, Coloradow and
shall file a copy thereof in the office of the Clark and Recorder of the
County of Lartmarl and another copy thereof in the office of the Clark of:the
City of port Collins. together with s certified copy of said petition and
another copy of said petition and approving ordinance with the Secretary of
#tat* of the State of Colorado.
Soction 2. That in accepting end approving the plat Of Fifth
South shields unenation to the City of Fort Collins, the City of Fort Collins
do** not assure obligations respecting the construction of water maloo, sewer
lines, a" rosins, electric light lines or other services or utilities with
respect to service of said addition, except " may be r*quired sad provided
by the owners of the property within the limits of said Addition in compliance
with the term* and provisions of Ordinance No. 7. 1921, AA amondsd, relating

May, to D. 1961 annexing what is knave as the Fifth South Shields Annexation to
the City of Fort Collins, Colorado.
