NOTE: THIS REPRESENTS THE BEST QUALITY IMAGE POSSIBLE TAKEN FROM VERY POOR QUALITY ORIGINALS ORDINANCE NO. 51 �, 1963 ACCEPTING AND APPROVING THE PUT OF WHAT IS KNOWN AS THE THUNDERBIRD ESTATES FOURTH ANNEXATION TO THE CITY OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURISDICTION THEREOF, PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE 11, CHAPTER 139, COLORADO REVISED PT T TES, 1953, WHEREAS, heretofore a written petition was presented to the Council of the laity of Fort Collins in substantial compliance with the provisions of Article 110 Chapter 139. Colorado Revised Statutes, by the owners of more than fifty per cent (50%) of the area and who compries the majority of landowners residing in the area of land embraced in what is known as the Thunderbird Estate& Fourth Annexation to the City of Fort Collias, wherein and whereby said petitioners petitioned the City of Fort Collins for annexation of all the territory embraced in what is known as the Thunderbird Estates Fourth Annexation to the City of Fort Collins, Colorado, comprising the lands shown in the plat thereof attached to said petition and more particularly described as hereinafter set forth, and WHEREAS, said pstitios was accepted by the Council of the City of Fort Collins by resolution passed and adopted on October 100 1963, and WHEREAS, notice for hearing on the 21st day of November, A. D., 1963. on an ordinance approving the annexation of said territory sad in- cluding the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law, and WHEREAS, the Council of the City of Fort Collins has found that the petition and the documents thereto attached moot the requirements of Article 11, Chapter 139, Colorado Revised Statutes, 1953, and WHEREAS, so proceedings for an election to determine the question of annexation have boon initiated by written counter -petition as provided by law and no objection to annexation having boon made, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That after due consideration of the potitioq for annex- stion, the petition for the annexation of all the territory in what is known and described as the Thunderbird Estates Fourth Annexation to the City of Fort Collins, Colorado, as shown by the plat thereof annexed to said petition and which is more particularly described as follows, to -wit: A tract of land situate in the Northwest k of Section 250 Township 7 North, Range 69 West, of the Sixth F.H., Lorimar Country, Colorado, which considering the North line of Said Northwest k as bearing N. 89*45' r. and with all bearings contained herein relative thereto, 1a contained within the boundary lines which begin at a point which boars N. 89*45' R. 200.00 feet from the Northwest career of said Section 25 and run thence S. 00*0014511 R. 190.00 feet; thence N. 89*45' R. 100.00 feet; thence N. 00*0014511 W. 190.00 foots thence S. 89*45' W. 100.00 feet to the point of beginning; be accepted sad approved and that said territory be annexed and made a part of the City of port Collins and be included within the limits and jurisdiction of the City of port Collins as a "D" Commercial District, and that the City Clark be and he is hereby authorised and directed to prepare certified copies of this ordinsnas, to each of which shall be attached aplat of said Thuader- bird Rstateo fourth Annexation to the City of port Collins, Colorado, mad shall file a copy thereof in the office of the Clark and Recorder of the County of Lariaer, and exotbor copy thereof in the office of the Clark of the City of port Collins, toSether with a certified copy of said petition and another copy of! said petition and approving ordimace with the secretary of state of the state of Colorado. $action 2. That in accepting and approving the plat of the Thunder- bird Rotates Fourth Annexation to the City of hart Collins, the City of port Collins does mot assume obligations respecting the construction of water mains, sewer time. See wise, electric light lines or other services or Utilities with respect to service of said addition, except as may be required amd provided by the ownere of the property within the limits of said addition in compliance with the torso snd provisions of Chapter 15.
