ORDINANCE NO. 56 , 1967,
BEING AN ORDINANCE ANNEXING CERTAIN TERRITORY TO THE CITY
OF FORT COi.LINS, COLORADO
WHEREAS, heretofore a written petition, together with four prints of
an annexation map, was filed with the City Clerk of the City of Fort Collins
requesting the annexation of certain territory more particularly described
below to the City of Fort Collins, Colorado, and
WHEREAS, the City Council has found and determined and does hereby
find and determine that said petition is in substantial cordpliance with the,
provisions of Colorado Revised Statutes, 1963, s 137-21-6, as amended, and
WHEREAS, the owners of one hundred per cent of the property to be
annexed have petitioned for said annexation, and
WHEREAS, not less than one -sixth of the perimeter of the area to be
annexed is contiguous with the City of Fort Collins and a community of interest
exists between the territory to be annexed and the City of Fort Collins and the
territory to be annexed is urban or will be urbanized in the near future and
such territory is integrated or is capable of being integrated with the City
of Fort Collins, and
WHEREAS;, none of the provisions of Colorado Revised Statutes, 1963,
9 139-21-4, as amended, are violated by the annexation of this territory to
the City of Fort Collins, and
WIIEREAS;, no election is required under the provision of Colorado
Revised Statutes, 1.963, d 139-21-6 (2) and no additional terms and conditions
are to be imposed in connection with this annexation, and
WHEREAS, the territory is eligible for annexation and the City Council
desires to annex the same to the City of Fort Collins.
COLLINS:
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
Section 1. That all of the territory more particularly described as
situate in the County of Larimer, State of Colorado, to -wit:
A tract of land situate in the Southwest < of Section 1, Town-
ship 7 Sorth, Range 69 West of the 6th p. M., Larimer County,
CoLorado, which considering the West line of the SW4 of said
Section 1 as bearing North and all bearings contained herein
relative thereto, is contained within the boundary lines which
begin at a point N. 89059' E. 862.03 feet from the Southwest
corner of said Section 1 and run thence North 254.68 feet;
thence N. 83°38' W. 319.90 feet; thence N. 81°05' W. 152.13
feet; thence N. 77°32' W. 167.76 feet; thence North 48.79
feet; thence S. 78°32'30" E. 204.08 feet; thence North 961.35
feet; thence N. 89°59' E. 1277.49 feet; thence S. 57°06'35"
E. 1111.04 feet; thence South 137.56 feet; thence S. 60°15'
W. 314.74 feet; thence S. 78°54' W. 686.10 feet; thence South
58.32 feet; thence N. 88°25' W. 259.25 feet;.thenge N. 85°06'
W. 255.24 feet; thence N. 84°33'45" W. 72.18 feet; thence S.
00°40' W. 33.78 feet; thence N. 85°18' W. 176.81 feet; thence
South 248.91 feet; thence N. 02°18'32" W. 875.00 feet along
the NE, line of the Second East Vine Drive Annexation; thence
S. 02016'32" W. 875.00 feet along the NW line of.the Second
East Vine Drive Annexation to the point of beginning, con-
taining 44.467 acres, more or less;
be and it hereby is annexed to the City of Fort Collins and made a part of said
City, to be imown as the Third East Vine Drive
Annexation to the City of Fort Collins.
Section 2. That in annexing said territory to the City of Fort
Collins, the City of Fort Collins does not assume any obligation respecting the
construction of water mains, sewer lines, gas mains, electric service lines,
streets or any other services or utilities in connection with the territory
hereby annexed except as may be provided by the ordinances of the City of Fort
Collins.
Introduced, considered favorably on first reading, and ordered
published this 121" day of October, 1967 , and to be presented for
final passage on the 2nd day November, A. D. 1967.
