ORDINANCE No. 59 , 1966,
ii6ING AN ORDINANCE ANNEXING CERTAIN TERRITORY TO THE CITY
OF FORT COLLINS, COLORADO_
WHEREAS, heretofore a written petition, together with four prints of
an annexation map, was filed with the City Clerk of the City of Fort Collins
requesting tine annexation of certain territory more particularly described
below to the City of Fort Collins, Colorado, and
WHEREAS, the City Council has found and determined and does hereby
find and determine that said petition is in substantial compliance with the.
provisions of Colorado Revised Statutes, 1963, s 137-21-6, as amended, and

WHEREAS, the owners of one hundred per cent of the property to be
annexed have petitioned for said annexation, and
WHEREAS, not less than one-si.xth of the perimeter of the area to be
annexed is contiguous with the City of Fort Collins and a community of interest
exists between the territory to be annexed and the City of Fort Collins and the
territory to be annexed is urban or will be urbanized in the near future and
such territory is integrated or is capable of being integrated with the City
of Fort Collins, and
WHEREAS, none of the provisions of Colorado Revised Statutes, 1963,
$ 139-21-4, as amended, are violated by the annexation of this territory to
the City of Fort Collins, and
Wiu?RtiAS, no election is required under the provision of Colorado
Revised Statutes, 1963, d 139-21-6 (2) and no additional terms and conditions
are to be imposed in connection with this annexation, and
WHEREAS, the territory is eligible for annexation and the City Council
desires to annex the same to the City of Fort Collins.
COLLINS:
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
Section 1. That all of the territory more particularly described as
situate in the County of Larimer, State of Colorado, to -wit:
A portion of the Southeast 1/4 of Section 18, Township 7
North, Range 68 West of the Sixth P.M., which considering

the South Zinc of said Southeast Y as hearing N. 88' 59' 40" E. and
with all hearings contained herein relative thereto is contained
within the boundary lines which begin at a point which bears N. 88°
59' 40" F, 267,97 feet from the South I corner of said Section 18
and run thcnee North 778,13 feet; thence West 268.80 feet; thence N.
110" 03' :i0" W, 419,64 feet; thence East 579,27 feet; thence South 73.59
feet; thence N. 89' 56' 40" E. 469,76 feet; thence along the arc of a
995,o foot radius curve to the right a distance of 63,86 feet, the long
chord of which bears S, 010 53' 40" E, 63,86 feet; thence S. 00' 03'
20"E 1047.13 feet to a point on the South line of said Southeast 4;
thence S, 88° 59' 40" W. 782,98 feet to the point of beginning, containing
23.186 acres more or less,
be and it hereby is annexed to the City of Fort Collins and made a part of said
City, to be known as the Birch Third
Annexation to the City of Fort Collins.
Section 2. That in annexing said territory to the City of "Fort
Collins, the City of Fort Collins does not assume any obligation respecting the
construction of water mains, sewer lines, gas mains, electric service lines,
streets or any other services or utilities in connection with the territory
hereby annexed except as may be provided by the ordinances of the City of Fort
Collins.

correct copy of Ordinance No, 59, 1966 annexing property to be known as the
Burch Third Annexation to the City of Fort Collins Colorado passed and adopted
on final reading on the 6th day of Octobers A. D. 1966.
