RIGHT OF WAY - DEDICATION
KNOW ALL MEN BY THESE PRESENTS: That the undersigned Phase III, Inc.
and Werner H. Postler, Erich K. Postler, John R. Riedman and Janet H. Ruff,
individually and as partners of Werr Investors, being the owners of real prop-
erty described below do hereby dedicate, transfer and convey to the City of
Fort Collins, Colorado, for public use forever a permanent 10 foot wide right
of way for the construction of public street and utility improvements in the
City of Fort Collins, County of Larimer, State of Colorado, more particularly
described on Exhibit "A" attached 'hereto and incorporated herein.
It is understood by the undersigned that, by acceptance of this dedica-
tion, the City of Fort Collins will not accept the duty of maintenance of such
right of way until permanent improvements have been constructed and accepted
by the City of Fort Collins,

A part of Lot 1 of Observatory Heights/ Subdivision, City of Fort
Collins, County of Larimer, State of Colorado, which begins at a
point on the South right-cf-way of East Horsetooth Road, which
bears S89'48'E 339.70 feet, and again South 30.00 feet from the
Northwest corner of Section 36, Township 7 North, Range 69 West of
the Sixth P.M., and runs
thence S89'48'E 108.30 feet;
thence South 10.00 feet;
thence N89'48'W 108.30 feet;
thence North 10.00 feet to the POINT OF BEGINNING, containing
1083 square feet.

Description of a 10 foot wide strip of land along the North side of

bears S89'48'E 111.80 feet, and again S00'241W 30.00 feet from the

the Sixth P.M., and runs
thence S89'48'E 228.11 feet;
thence South 10.00 feet;
thence N89'48'W 238.18 feet;
thence N45'18'E 14.17 feet to the POINT OF BEGINNING, containing
