B 2 2 3 7 P9479 52 1 1 04 1983iC il1C.:24 COUNTY CF7 U,RIJH` % 1 r1 TEE 0'17 ORDINANCE NO. 97, 1983 OF THE COUNCIL OF THE CITY OF FORT COLLINS ANNEXING PROPERTY KNOWN AS THE EAST VINE DRIVE SIXTH ANNEXATION TO THE CITY OF FORT COLLINS, COLORADO WHEREAS, Article II, Section 30 of the Constitution of the State of Colorado requires that one of the following conditions be met before an unincorporated area be annexed to a municipality: 1. The question of annexation be submitted to a vote of the landowners and registered electors of the area to be annexed and the majority of such persons voting, vote in favor of annexation; or 2. The annexing municipality receive a petition for annexation signed by more than 50% of the landowners in the area who own more than 50% of the land; or 3. The area to be annexed be entirely surrounded by or be solely owned by the annexing municipality; and WHEREAS, 100% of the landowners in the East Vine Drive Sixth Annexa- tion area have signed a petition for annexation; and WHEREAS, not less than one -sixth (1/6th) of the perimeter of the area to be annexed is contiguous with the City of Fort Collins and a community of interest exists between the territory to be annexed and the City of Fort Collins; and the territory to be annexed is urban or will be urbanized in the near future; and such territory is integrated or is capable of being integrated with the City of Fort Collins; and WHEREAS, no election is required and no additional terms and condi- tions are to be imposed in connection with this annexation; and WHEREAS, 'the Council has found and determined and does hereby find and determine that said petition is in substantial compliance with the annexa- tion laws of the State of Colorado and that the territory is eligible for annexation, and the City Council desires to annex the same to the City of Fort Collins; and NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: 82232 POMI S I Section 1„ That the following described property: A tract of land situate in the County of Larimer, State of Colorado to -wit: A tract of land situate in Sections 5, 6, 7 and 8, Township 7 North, Range 68 West of the Sixth P.M., Larimer County, Colorado, which considering the South line of said Section 6 as bearing S 88°15'16" W and with all bearings contained herein, relative thereto, 'is contained within the boundary lines which begin at a point on the South line of said Section 5 which bears S 89°32'48" E 100.00 feet from the Southeast corner of said Section 6, and run thence N 00003'56" E 3058.87 feet to the centerline of the Larimer and Weld Canal; thence along said centerline, S 52°59'04" E 366.87 feet; thence S 00003'56" W 2920.32 feet to a point on the South line of the Colorado and Southern railroad; thence along said South line, N 89°32'48" W 393.09 feet; and again S 88015'16" W 5179.96 feet to the East line of Lemay Avenue; thence N 00004'32" W 110.00 feet to a point on the North line of East Vine Drive; thence along said North line, N 88015'16" E 2082.00 feet to the boundary line of lands presently owned by East Vine Properties; thence along said boundary line, N 00004'32" W 3216.79 feet; and again N 89°06'12" E 1793.59 feet; and again S 00015'10" W 3220.80 feet to the South line of said Section 6; thence along said South line, N 88°15'16" E 1322.35 feet to the Southeast corner of said Section 6; thence S 89°32'48" E 100.00 feet to the point of beginning containing 163.9613 acres more or less. Subject to all rights -of -way, easements, and restrictions as now in use and of record. Said property contains 163.9 acres, more or less gross. be, and it hereby is, annexed to the City of Fort Collins and made a part of said Citv. to be known as the East Vine Drive Sixth Annexation. Section 2. That in annexing said territory to the City of Fort Collins, the City of Fort Collins does not assume any obligation respecting the construction of water mains, sewer lines, gas mains, electric service lines, streets or any other services or utilities in connection with the territory hereby annexed except as may be provided by the ordinances of the City of Fort Collins. Section 3.
