Dear Mr. Finney:
KEM Homes, Inc. is requesting permission to complete some development
work on the above mentioned project, prior to obtaining final approval of
our PHA application. As noted in previou discussions, Phase I is one part
of our Parkwood East Condominium project. IZFM homes is now in the process
of starting our Prase II on a conventional basis; however, some development
must be done on Phase I in conjunction with the development of Phase Y.
KEM has two items of work that need to be done in Phase I. Tka first
concerns our overlot grading. The parking lot in Phase I is mostly a fill
area, while the parking lot in Phase II is a cut area. KEM will be placing
and compacting the cut from Phase II into the Pill area of the parking lot
on Phase I. All fill will be placed and compacted under the supervision of
a soils engineer. The second area of work concerns the water main that
services both Phase I and Phase 11 of the project. InK rain forms a con-
tinuous loop from the existing water main located in StuartStreet and the
existing water main located in Creekwood Drive. According to our agreement

with the city of Port Coll -ins, no building permits are to be issued in
Phase II untilthe water line is installed.
Some other items to bring to your attention - KEM llomes is the
developer of the project and has a development loan at Empire Savings
and Loma for this work. Also, the water main is maintained by the city
of Dort Collins and has to be installed and inspected according to city
specifications.

Tan:
I regret that you feel I am being "picky" about requiring more back-
up material prior to our paying oversizing bills. I am enclosing the
referenced invoice along with what is reputed to be "Duplicate of
Flatiron Statement." Frankly, Tan, I'm having trouble recognizing
the support data as a "Flatiron Statement."
You will recall, I'm sure, our previous telephone conversations re-
garding the series of billing for Parkwood East and, per your instructions,
I ignored all previous invoicing for this project when you submitted your
letter of January 12, 1981, enclosing your Invoice Number 2906 in the
amount of $7,,830.96 which was summarized on Flatiron's letter to you of
January 5, 1981. If I misinterpreted your letter and phone conversations,
Tan, I will be happy to recommend payment. However, I am sure you will
recognize my confusion when you have had time to review these invoices.
I apologize for the City's ineptness in the two nonsupported invoices
you received fran us and can understand your frustration too.
I regret that I am not familiar with the invoices but, I assure you, if
you will give me the details, I will be happy to investigate the problem
and see that the proper person gets you the information.
Please advise the disposition you wish me to make on Invoice 2992 (same
as 2876 dated 11-26-80).
