HomeMy WebLinkAboutPOUDRE R-1 CITY OF FORT COLLINS - Filed ED-EASEMENT DEDICATION - 2008-10-09RECEPTION#: 20080060240, 09122y2008 at 01:47:40 PM, 1 OF 1, R $6.00 TD Pgs: 0 Scott Doyle, Larimer County, CO EASEMENT FOR CONSTRUCTION AND MAINTENANCE OF PUBLIC UTILITIES Poudre School District R-1, hereinafter referred to as "the Grantor", of the County of Larimer, State of Colorado, does hereby grant and convey to the City of Fort Collins, Colorado, a municipal corporation, its licensees, successors and assigns, hereinafter referred to collectively as "the Grantee", in consideration of the payment by the Grantee of the sum of $1,224.00, and other good and valuable consideration, receipt of which is hereby acknowledged, a right-of-way and easement for the installation and continued operation, maintenance, repair, alteration, inspection, and replacement of the public utilities of the Grantee (including, without limitation, cable television), in, on, under, across and above the following premises, belonging to the Grantor in Larimer County, State of Colorado, in the following location: A parcel of land in the SW '/a of Section 4, Township 6 North, Range 68 West of the 6° P.M., more Particularly described as follows: Commencing at the center %comer of said Section 4 and considering the North line of the SW Ye of said Section 4 to bear N89"07'08" W with all other bearings contained herein relative thereto: Thence along the North line of the SW Ye of said Section 4 N89-07'08"W 2,624.18 feet; Thence S01`59'36"E 92.87 feet; Thence 24.31 feet along a curve to the right having a radius of 15 feet, a central angle of 92"52'28" and a chord which bears N44`26'38"E 21.74 feet; Thence S89"07'08"E 60 feet to the True Point of Beginning: Thence S01 "59'36"E 24 feet; Thence S89"07'08"E 15 feet; Thence N01 "59'36"W 24 feet; Thence N89"07'08"W 15 feet to the True Point of Beginning; (Said easement contains 360 square feet adjacent to South right of way line of Rock Creek Drive approximately 50 feet East right of way line of Ziegler Road.) Together with all rights of ingress and egress necessary for full and complete use, occupation, and enjoyment of the easement hereby granted, and all rights and privileges incident thereto, including the right, as becomes necessary, to cut, trim, and remove trees, brush, overhanging branches, and other obstructions which may injure or interfere with the Grantee's electric utility system. The Grantee shall be responsible for the reasonable restoration of the Grantors property upon completion of installation or otherwise compensate the Grantor for damage done during construction or subsequent reentry for repair or reconstruction purposes. The Grantor states that it is the lawful owner in fee simple of the real property described herein; that it has a good and lawful right and authority to grant, sell, and convey said property or any part thereof and that it warrants the title of said property.
