The design intent for Old Oak Estates, zoned UE (Urban Estate), is to utilize the 4.985 acre site for 6 single family detached dwellings. 2. Lot 1 and Lot 3 through Lot 6 shall be custom—built single family homes to be designed and illustrated in the future, and subject to the building permit review process. 3. See calculations on this sheet for density information. All lots with in this project are in compliance with the definition of Urban Estate zoning density with the exception of Lot 6. A modification to reduce the size of Lot 6 was approved on (February 24, 2008). 4. Lighting plans and photometrics are not provided at this time because all lots are to be single family. All lighting shall conform to Section 3.2.4 of the Land Use Code. 5. Custom homes are being proposed and therefore actual buildings have not been designed at this time. Actual building footprints and specific building areas are not provided on this site plan. All buildings shall be in compliance with Section 3.5.2 and Section 4.2 of the Land Use Code. Lots 2, 3, 5 and 6 shall have driveway access from emergency and private access drive. There shall be no vehicular access from Strauss Cabin Road. 6. Lot 1 and Lot 4 shall have driveway access from Big Dipper Drive. 7. It is the responsibility of the Developer and their Contractor to build the project according to the final approved plans and in accordance with the current Land Use Code and Landscape Guidelines. Field conditions that conflict with or jeopardize the longevity of the proposed improvements shall be brought to the attention of the City for resolution. 8. For ever resident ial building, the fro nt yard setback sha ll all be thin 30 feet t from the Ya Y ( ) right—of—way or private drive, the minimum side yard setback shall be twenty (20) feet from the side property line and the minimum rear yard setback shall be twenty—five (25) feet from the rear property line. It is the responsibility of the Developer and their Contractor to build each building in accordance with these setback guidelines. 9. Any fencing constructed along the east property line of Lots 5 & 6 shall comply with the requirements of Section 3.8.11, Fences and Walls,' of the Land Use Code. 10. The owners of Lots 5 & 6 shall be responsible for the maintenance of any portion of their lot located outside any perimeter fence including, but not limited to, ground cover, shrubs, trees and any and all landscaping associated with the parkway along Strauss Cabin Road. Gates shall be provided so owners can access Strauss Cabin Road for landscaped maintenance. 11. No fence shall be closer than two (2) feet or any public sidewalk. 12. All garages shall comply with Section 3.5.2(E) of the Land Use Code. 13. No signs, fences or walls exceeding forty—two (42) inches in height shall be placed within the area designated for the sight distance triangle. All fences or walls exceeding thirty—two (32) inches in height shall be constructed of split rail with a minimum dimension of twelve (12) inches between horizontal members. All signs, fences and wall within the sight distance triangle shall be in conformance with Section 3.8.11(C)(4) and Section 3.8.7(G)(1) of the Land Use Code 14. Private Conditions, Covenants, and Restrictions (CC&R's), or any other private restrictive covenant imposed on landowners within the development, may not be created or enforced which has the effect of prohibiting or limiting the installation of xeriscape landscaping, solar/photo—voltaic collectors (if mounted flush upon any established roof line), clothes lines (if located in back yards), odor —controlled compost bins, or which has the effect of requiring that a portion of any individual lot be planted in turf grass.
