Development Agreement _ Dear Mike: As we discussed on the telephone, the amended Development Agreement requires a certification that the five lots along "Timberline Road to which the Amendment relates (lots 157, 169, 1807 181 and 192) have been graded to elevations and contoured in accordance with the approved utility plans. To satisfy this requirement, attached for your review is a letter from RBD to Tom Di Rito certifying the overlot grading as to all the lots, together with a map showing the verifications for each lot. 1 am working with Matt Baker in engineering to coordinate the amount of security that needs to be posted for the sidewalk improvements. Aside from finalizing the amount and posting it, please let me know if there is anything else that needs to be done prior to obtaining building permits for these lots. I thought it would be a good idea to get it in the mail rather than waiting until I came up again. Would you please send me a copy signed by the City when you can? The proposed 2 inches of surface course and 3 inches of bituminous base course recommended by Lester Litton of Earth Engineering meets the structural loading requirements set by the City of Fort Collins. However, the City does prefer to see composite pavement sections of asphalt and gravel base course (Class V or VI) used in local street design. Development Agreement Dear Matt: One of the conditions contained in the Amendment to the Harmony Crossing P.U.D. Development Agreement (attached) is that the Developer must escrow funds with the City sufficient to guarantee completion of the sidewalk along Timberline Road adjacent to lots 157, 169, 180, 181 and 192, prior to obtaining building permits. The amount must be 150% of the City approved contract unit prices for the improvements. Per our telephone conversation a couple of weeks ago, you indicated that the escrow amount is $4,939.00 for all five lots. Accordingly, enclosed is a check in this amount. It is our understanding that the funds will be held in escrow by the City pending completion of the improvements. Please let us know if anything further is required to obtain building permits on the referenced lots. Box 580 Fort Collins, Colorado 80522 Dear Mike: April 13, 1995 Regarding the Harmony CrO�Sing P,U.D. and our property on their south boundary, we have had some communication with Bud Curtis of R.B.D. relative sidewalk elevations. We have looked at the propertiea with Bud and have consulted with our engineers - Ayers Engineering (R.C, E.). Our engineers saw no problem with the elevation of their sidewalk and our adjoining boulevard. Although our sidewalk and boulevard will be at a lower elevation than Timberline Road, our engineers believe there will not be a drainage problem since we have an adjacent 40' drainage swale. Development Agreement Dear Mike and Paul: As 1 discussed with Paul on the telephone, Richland requests a modification of Harmony Crossing P.U.D. Development Agreement concerning the installation of the sidewalk along Timberline Road. Paragraph I1(D)(5) of the Development Agreement (copy attached) provides that no building permits shall be issued for lots 157, 158, 168, 169, 180, 181 and 192 until the street improvements on Timberline Road have been completed with at least the construction of curb, gutter and sidewalk, and said improvements have been approved by the City. F'nclosed is a copy of the Landscape Plan for Harmony Crossing. The lots along Timberline Road referenced in the Development Agreement are highlighted in blue. These lots actually front on interior streets, and Timberline Road faces the sides of these lots. These lots will be separated from Timberline Road by a landscaped buffer (noted in green), through which a meandering sidewalk will be constructed (as shown). Richland also plans to construct a six foot fence along the east side of the subject lots, separating these lots from the landscaped buffer, also as shown on the landscape Plan. DEUTSCII. November 23. 1994 Page Two Richland is in the process of finishing the first phase of the lots, which we believe will be completed by the middle of next month. The Timberline Cooperative .loint Venture (of which Richland is a member) is completing the Timberline Road improvements, including the sidewalk. The Joint Venture has indicated that because of scheduling considerations, the sidewalk will not be installed until Spring. We would like to amend the Development Agreement to provide that building permits may issue for the subject lots along Timberline Road, but that no Certificates of Occupancy will be issued for these lots until the sidewalk along Timberline Road is completed. This will allow us to obtain building permits for these lots, while still providing the City adequate assurances that the sidewalk will be in before homes actually are occupied along "timberline Road. Would you please review the enclosed and let us know whether the proposed amendment to the Development Agreement is feasible? As indicated, we hope to draw down building permits for these lots next month, so we would appreciate hearing from You as soon as possible. We understand your staff is quite busy, and we certainly appreciate your assistance in helping us work this out. Please be informed that this letter of acceptance does not relieve the developer or the contractors, lot owners, or their contractors, of their responsibility for the repair of any damage which may occur as a result of the building construction. Spillane Deutsch, Spillane & Reutzel, P.C. 7730 East Belleview Avenue, Suite 206 Engle wood, CO 80111 RE: Harmony Crossing Dear Mr. Spillane: vices This letter is in response to your FAX letter request dated May 25, 1994, regarding the Harmony Crossing P.U.D. You mentioned that the land within the P.U.D. previously had an Exemption Plat which contained a note stating that no further divisions of the tracts could be done by the exemption process. You asked that I state that the note on that plat is no longer in effect. Since the City of Fort Collins has no exemption process, I assume that the Exemption Plat was approved while the property was in the County. The property is now in the City of Fort Collins, and the City has jurisdiction over the platting of land. The plat approved by the City for the Harmony Crossing P.U.D. is considered a valid splitting of the property. You may want to contact the Larimer County Planning office for a further explanation of the Exemption Plat process. Their phone number is 498-7683. Let me know if you have any further question.
