ROGERS and D. J. COILING (hereinafter referred to as "West Owners") and SCOTT REALTY CO., a Colorado corporation and LEONARD BOROWSKI (hereinafter referred to as "East Owners"), WITNESSETH: WHEREAS, West Owners own the following described property, to - wit: The North 30 feet of the East 12 feet of the West 15 feet of Lot 5, RCD Plaza South Subdivision, according to the recorded plat thereof, Fort Collins, Larimer County, Colorado (West property); and WHEREAS, East Owners are the owners of the following described property, to -wit: North 30 feet of the West 12 feet of the East 135 feet of Lot 5, RCD Plaza South Subdivision, accord- ing to the recorded plat thereof, Fort Collins, Larimer County, Colorado (East property); and WHEREAS, the parties desire to create a "cross easement" for ingress and egress purposes over and across the East and West property; NOW, THEREFORE, it is agreed, upon the exchange of mutual con- sideration, the adequacy and receipt of which is acknowledged by each of the parties hereto as follows: East Owners do hereby grant to West Owners, and any subsequent owners, occupants, or tenants of Lot 4 and the West 15 feet of Lot 5, RCD Plaza South Subdivision, according to the recorded plat thereof, Fort Collins, Larimer County, Colorado, and any guests, invitees, sub- tenants, successors in interest, or assignees of the West Owners or such other described persons or entities, an easement for ingress and egress over and across the East property. West Owners do hereby grant to East Owners, and any subsequent owners, occupants, or tenants of the East 135 feet Of Lot 5, RCD Plaza South Subdivision, according to the recorded plat thereof, Fort Collins, Larimer County, Colorado, and any guests, invitees, subtenants, successors in interest, or assignees of the East Owners or such other described persons or entities, an easement for ingress and egress over and across the West property.
