HomeMy WebLinkAboutSTRACHAN STANFORD ROAD - Filed RV-ROW VACATION - 2008-05-22ORDINANCE NO. 123, 1977 BEING AN ORDINANCE VACATING JOHNSMITH STREET AND A DITCH EASEMENT DtDICATED IN THE STRACHAN SUBDIVISION, FIRST FILING WHEREAS, the plat of the Strachan Subdivision, First Filing, dedicated to the City Johnsmith Street as shown on said subdivision plat and an easement for a ditch as shown on such plat; and WHEREAS, Johnsmith Street as laid out and dedicated on said plat has not been opened to the public and the owner of all property abutting such street. has requested that the street be vacated and the street is not needed for municipal purposes now or in the future; and WHEREAS, the ditch for which the ditch easement was established through said subdivision has been abandoned and, therefore, the easement for such ditch is no longer needed nor will the same be needed for municipal purposes in the future; and WHEREAS, the City Council desires to vacate such street and ditch easement. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that that certain street shown on the plat of Strachan Subdivision, First Filing, designated as Johnsmith Street and that certain ditch easement shown on said subdivision plat be, and the same hereby are, vacated, abated and abolished. Introduced, considered favorably on first reading and ordered published this 18th day of October , A.D. 1977, and to be presented for final :passage on the lst day of November A.D. 1977. ATTEST: i y Clerk Passed and adopted on final reading this lst day of November A.D. 1977. n ATTEST: City Clerk 393620 COM, Y OF LARNER 1930 DEC 2 G AM 10� 14 STATE 0i �OLORADO ORDINANCE NO. 166, 1980 OF THE COUNCIL OF THE CISTF FORT COLLINS VACATING A PORTION OF THE STANFORD ROAD RIGHT-OF-WAY IN STRACHAN SUBDIVISION WHEREAS, Stanford Road was platted in the Strachan Subdivision as a collector street with a 100 foot wide right-of-way and a 60 foot wide pavement; and WHEREAS, Mitchell and Company has petitioned the Council of the City of Fort Collins to vacate the westerly 11 feet of said right-of-way, more particularly described below; and WHEREAS, upon vacating a portion of the Stanford Road right-of-way, the remaining right-of-way will be consistent with present City standards; and WHEREAS, it appears that the rights of the residents of the City of Fort Collins will in no way be prejudiced or injured by the vacation of said portion of right-of-way. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the following described portion of the Stanford Road right- of-way, to-w-it: A part of Stanford Road which begins at a point which bears N 00°14130" W 18.77 feet from the Southeast corner of Lot 2, Strachan Subdivision, First Filing, Fort Collins, Colorado, and runs thence N 00°14'30" W 706.38 feet; thence along the arc of a 15.00 foot wide radius curve to the left a distance of 23.56 feet, the long chord of which bears N 45°14'30" W, 21.21 feet; thence N 89*45130" E, 11.00 feet; thence along the arc of a 15.00 foot wide radius curve to the right a distance of 23.56 feet, the long chord of which bears S 45"14'30" E, 21.21 feet; thence S 00°14'30" E, 626.05 feet; thence along the arc of a 298.80 foot radius curve to the right a distance of 81.33 feet, the long chord of which bears S 07°33'20" W, 81.07 feet to the point of beginning, be, and the same hereby is, abolished, vacated and abated, said right-of- way riot being needed for any municipal purpose. ATTEST tmI ity C er�C � -2- MAY Ni .1 i ulen yf.:G' ORDINANCE NO. 20, 1972, BEING AN ORDINANCE VACATING A ROAD RIGHT-OF-WAY THROUGH STRACHAN SUBDIVISION, FIRST FILING WHEREAS, the owners thereof heretofore dedicated rri=a� for road right-of-way purposes a road described in dedication deed recorded September 19, 1970, in Book 1441 at Page 921 of the Larimer County records, the description for which was corrected by affidavit filed by .James II. Stewart, professional engineer and land surveyer on September 22, 1970, in Book 1442 at Page 341, and WHEREAS, the owners of the property adjoining the same have peti- tioned the City to vacate said road as hereafter described, and WHEREAS, said road is not needed for municipal purposes and will not be needed for municipal purposes in the future, and WHEREAS, it appears that the rights of the residents of the City of Fort Collins will in no way be prejudiced by the vacation of said road. NOW, THEREFORE, be it ordained by the Council of the City of Fort Collins, that the roadway, more particularly described as follows, to -wit: A tract of land situate in the Southwest 1/4 of Section 25, Township 7 North, Range 69 West of the Sixth P.M., County of Latimer, State of Colorado, which considering the South line of said Southwest 1/4 as bearing N 89°43' E and with all bearings contained herein relative thereto is contained within the boundary lines which begin at a point which bears N 89' 43' E 391.79 feet from the Southwest corner of said Section 25 and run thence N 00005' W 329.95 feet; thence along the arc of a 15-foot radius curve to the left a distance of 23.61 feet, the long chord of which curve bears N 45011' W 21.25 feet; thence S 89°43' W 314.96 feet to a point on the Easterly right-of-way line of Colorado State Highway No. 1 (also known as South College Avenue); thence N 00005' W 253.66 feet along said Easterly right-of-way line; thence S 89°04130" E 50.01 feet; thence S 00°05' E 177.56 feet; thence along the arc of a 15-foot radius curve to the left a distance of 23.61 feet, the long chord of which curve bears S 45°11' E 21.25 feet; thence N 89043' E 324.96 feet; thence S 00°05' E 405.00 feet to a point on the South line of said Southwest 1/4; thence S 89°43' 1V 60.00 feet along said Southline to the point of beginning. be and the same hereby is abolished, vacated and abated.
