VACATING A PORTION OF LINCOLN AUCINING B1311 15
AND A PREVIOUSLY VACATED PORTION OF LINCOLN AVENUE IN
THE CITY OF FORT COLLINS, COLORADO..
WHEREAS, portions of Lincoln Avenue were heretofore vacated by certain
ordinances, being Ordinance No. 1, 1945, and ordinance No. 7, 1954, and
1,,JM A3, the Colorado Lulling and Elevator Company is the owner of that
portion of Block 15 and a vacated portion of Lincoln Avenue which adjoins the
following portion of Lincoln Avenue, to -wit:
Beginning at a point from which the Southeast corner of Block
15 in the City of Fort Collins, Colorado, bears South 88°353
a distance of 78.00 feet, and running thence North W151
E. 72.00 feet, thence K. 71*201 W. 32.00 feet, to a point on
the Southeast line of said Block 15 which is N. 41'101 S.
107.00 feet from the Southeast corner of said Block, thence
N. WWI E. 83 feet, along the Southeast line of said Block,
thence S. 48.51, 3. 33.10 feet, thence S. W151 W. 115.30
feet, and thence S. 74°351 W. 37.0; feet, to the point of be-
ginning; containing 0.121acres more or less;
AND, WHEREAS, the Colorado Pulling and Elevator Company, through the
local manager of the Ranch=day Feed I*ill Company, a branch of said Colorado Milling
and Elevator Company, has filed a petition for the vacation of the above described
portion of Lincoln Avenue, and
hhdass, said portion of Lincoln Avenue has never been openad to toe
ablic and has never been used for street purposes, and
VMEREAS, said portion of Lincoln Avenue is not necessary for any purpose
by the public and is detrimental to the abutting land owner which needs the same
for a building location, and
WHEREAS, the City Council is of the opinion that it will be to the best
interests of the City of Fort Collins to vacate said portion of Lincoln Avenue.
NCW, THERSKRE, BE IT ORDAINED BY THE CITY CCUNCIL OF THE CITY OF FORT
COLLINS:
Section 1. That that portion of Lincoln Avenue in the City of Fort
Collins, Colorado, more particularly described as follows, to -wit:
Beginning at a point from which the Southeast corner of Block
15 in the City of Fort Collins, Colorado, bears South 80°351
E. a distance of 73.00 feet, and running thence North 18°151
E. 72.00 feet, thence 3. 71°201 i.. 32.00 feet, to a point on
the Southeast line of said Block 15 which is N. 41*101 E.
107.00 feet from the Southeast corner of said Block, thence
N. 41'IO1 E. 83 feet, along the Southeast line of said Block,
thence S. 480501 E. 33.10 feet, thence S. 150151 W. 115.30
feet, and thence C. 74°35' W. 37.00 feet, to the point of be-
getting; containing 0.121 acres more or less;
be and the same is hereby vacated, abolished and abandoned..
Section 2. That rights of way or easements are hereby reserved for the
continued use of existing sewer, gas, water or similar pipe lines and appurtenances,
and for electric, telephone and similar lines and appurtenances.
Introduced, considered favorably on first reading and ordered published
this 8th day of September , A. D. 1955s and to be presentea for final
passage on the 13th day of October , A. D. 1955.
