HomeMy WebLinkAboutMOUNTAIN VIEW ADDITION - Filed RV-ROW VACATION - 2008-03-21s ORDINANCE NO. 17 , 1958 - BEING AN ORDINANCE VACATING PORTIONS OF ALLEYS AND POR- TIONS OF MAPLE STREET IN MOUNTAIN VIEW ADDITION, ACCORD- ING TO THE PLAT DATED FEBRUARY 7, 1922 WHEREAS, the plat of Mountain View Addition, dated February 7, 1922, shows an East-West alley in Block 2 of said Mountain View Addition, and a North -South alley in said Block 2, and also shows that Maple Street, as dedicated, has a width of 80 feet and WHEREAS, said East-West alley has never been open to the public and has never been used as an alley, and WHEREAS, the South 253.92 feet of said North -South alley has never been open to the public or has never been used as an alley, and WHEREAS, Maple Street, as platted and laid out in the Columbine Court, Second Subdivision is but fifty (50) feet in width and WHEREAS, portions of Maple Street, as dedicated through Mountain View Addition, has not been improved and should conform with the extension of Maple Street through Columbine Court Second Subdivision, and WHEREAS, the owners of the lots abutting on said alleys and on said Maple Street have petitioned the City Council to close portions of said alleys and a portion of said Maple Streetto be vacated, and WHEREAS, the City Council is of the opinion that it will be to the best interest of the City of Fort Collins to vacate portionsof said Maple Street and said alleys, NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That the entire East-West alley in Block 2 of Mountain View Addition, according to plat filed February 7, 1922, and more particularly described as follows, to -wit: Beginning at the SW corner of Lot 1 and running thence S. 20 feet to the NW corner of Lot 19, thence E. 250 feet to the NE corner of Lot 15, thence N. 20 feet to the SE corner Of Lot 5, and thence W. 250 feet to the point of beginning, all being in Block 2 of said Mountain View Addition, be and the same is hereby vacated, abolished and abandoned. Section 2. That a portion of the North -South alley in Block 2 in Mountain View Addition, according to plat filed February 7, 1922, and more particularly described as follows, to -wit: Beginning at the NE corner of Lot 15 and running thence E. 20 feet to a point on the West line of Lot 10, which is 253.92 feet North of the SW corner of Lot 14, thence S. 253.92 feet to the SW corner of Lot 14, thence W. 20 feet to the SE corner of Lot 15, and thence N. 253.92 feet to the point of beginning, all being in Block 2 of said Mountain View Addition, be and the same is hereby vacated, abolished and abandoned. Section 3. That portions of Maple street, situate between Block 1 and Block 2 in Mountain View Addition, according to plat filed February 7, 1922, and more particularly described as follows, to -wit: Beginning at the SE corner of Lot 3 in Block 1 of Mountain View Addition, and running thence Southerly 15 feet along the extension of the East line of said Lot 3, thence West 185,17 feet, more or less, parallel to the South line of said Lot 3, to a point on the extension of the West line of said Lot 3, thence Northerly 15 feet, to the SW corner of said Lot 3, and thence East 185.25 feet, along the South line of said Lot 3, to the point of beginning; Also that portion of Maple street contained within boundary lines beginning at the NE corner of Lot 6 in Block 2 of Mountain View Addition and running thence Northerly 15 feet, along the extension of the East line of said Lot 6, thence West 184.89 re or less, parallel to the North line of said Lot 6; to Point on the extension of the west line of said Lot 6, thence South 15 feet, to the NW corner of said Lot 6, and thence East 184.81 feet, along the North line of said Lot 6 to the point of beginning, and Beginning at the SE corner of Lot 4 in Block 1 in said Mountain View Addition and running thence South 80 feet, to the NE corner of Lot 5 in Block 2 of said Mountain View Addi- tion, thence West 250 feet, to the NW corner of Lot 1 in Block - 2 - 2 of Said Mountain View Addition, thence Borth 80.feet, to the SW corner of Lot 8 in Block 1 of said Mountain View Addition, and thence East 250 feet to the point of beginning, be and the same are hereby vacated, abolished and abandoned. Introduced, considered favorably on first reading and ordered pbblished this 8th day of May, A.D. 1958, and to be presented for final Passage on the 12th day of June, A.D. 1958. TO THE CITY COUNCIL OF THE CITY OF FORT COLLINS, COLORADO. Gentlemen: We, the undersigned, being the owners of Late 1, 21 3, k, 5, 15, 16, 17, 18 and 19, in Block 2 of Mountain View Addition, according to the plat dated February 7, 1922, and now a part of the City of Fort Collins, do hereby petition the City Council of the City of Fort Collins to pass and adopt an Ordinance vacating the following described alley, abutting on said Lots to wit: - That portion of an alley in the Mountain View Addition contained within boundary lines beginning at the Southwest corner of Lot 1 and running thence South 20 teat, to the Narthwet corner of Lot 19, thence East 250 feet, to the Northeast corner of Lot 15, thence North 20 feet, to the Southeast corner of Lot 5, and thence West 250 feet, to the point of beginning, all in Block 2 of said Mountain View Addition. bThe undersigned petitioners do hereby declare that said alley has never eon opened to public travel, that no public funds have been expended on said alley, that the vacation of said alley is necessary to enable the platting of a street planned for this area and that it would be to the beet interests of the City to have said alley vacated. Fort Collins, Colorado, April 30, 1958. TO THE CITY COUNCIL OF THE CITY OF FORT COLLINS, COLORADO. Gentlemen: We, the undersigned, being the owners of Lot 3 in Block 1 and Lot 6 in Block 2 of the Mountain View Addition, according to the plat dated February 7, 1922, and now a part of the City of Fort Collins, Colorado, do hereby petition the City Cduncil of the City of Fort Collins, Colorado, to pass and adopt an Ordinance vacating the following described portions of Maple Street, abutting Lot 3 in Block 1 and Lot 6 in Block 2 of said Mountain View Addition, to wit: - That portion of Maple Street contained within boundary lines beginning at the Southeast corner of Lot 3 in Block 1 of Mountain View Addition, and running thence Southerly 15 feet along the extension of the East line of said Lot 3, thence West 185.17 feet, more or less, parallel to the South line of said Lot 3, to a point on the extension of the West line of said Lot 3, thence Northerly 15 feet, to the Southwest corner of said Lot 3, and thence East 185.25 feet, along the South line of said Lot 3, to the point of beginning, Also that portion of Maple Street contained within boundary lines begin- ning at the Northeast corner of Lot 6 in Block 2 of Mountain View Addition and running thence Northerly 15 Peet, along the extension of the East line of said Lot 6, thence West 184.89 feet, more or less, parallel to the North line of said Lot 61 to a point on the extension of the West line of said Lot 6, thence South 15 feet, to the Northwest corner of said Lot 6,. and thence East 184.81 feet, along the North line of aaid Lit 6 to the point of beginning. The undersigned petitioners hereby state that said portions of Maple Street are not now improved, that the vacation of the above described portions of Maple Street will have the effect of narrowing said street from its present width of 80 feet to a new width of 50 feet and that said width of 50 feet will conform with the width of the street now platted and laid out in the Columbine Court Second Subdivision, which said street will eventually be platted and laid out to conform with the portion of Maple Street remaining after the above described portions are vacated.
