HomeMy WebLinkAboutTESTA - Filed OA-OTHER AGREEMENTS - 2008-02-13LETTER OF AUTHORIZATION June 8, 2007 To whom it may concern, Frank and Susan Montoya, located at 1623 South Lemay Ave, Fort Collins, Colorado authorize John and Nancee Testa, who will operate a business at 1635 South Lemay Ave, Fort Collins, Colorado to maintain landscaping on a portion of the Montoya's property. In 1997 a wooden privacy fence was constructed which belongs to Frank and Susan Montoya located between the 1623 and 1635 South Lemay Avenue properties. The actual property boundary lies approximately 2.5 feet on the south side of this fence. The owner at 1635 South Lemay Ave has been maintaining this area to the south of the privacy fence since installation. When the Testa's submitted a proposed business plan to the City of Fort Collins Planning Department, it was found that the land Use Code requires a 5 foot landscape setback from the Montoya's fence to the north side of the driveway. Approximately 2.5 feet of Montoya's property is Included in this setback. This letter will allow the Montoya's portion of land south of the fence to be considered as part of the required 5' landscape setback, which will be maintained by the Testa's business.
