TERMINATION OF EASEMENT
For value received, Xcet Energy, Inc., formerly known as Public Service Company of
Colorado, a Colorado corporation ("Xcel"), hereby terminates the easement described in
instrument recorded .tune 13, 1985 in the real estate records of Larimer County, Colorado at
Reception No. 85028305 ("Easement") attached hereto across the property described on Exhibit
A, attached hereto, and hereby quit claims to Lot Holding Investments, LLC any interest of Xcel
derived from the Easement in, under, across or on the property described on Exhibit A.

LEGAL DESCRIPTION FOR THE VACATION OF A GAS LINE EASEMENT
A portion of a 30' wide gas easement as described in Reception No. 85028305 to be
vacated situate in the Southwest quarter of Section 1, Township 7 North, Range 69 West
of the 61" P.M., City of Fort Collins, County of Larimer, State of Colorado, also being
within Old Town North, a subdivision on record in the office of the Clerk and Recorder of
said County, and being more particularly described as follows;
Considering the West line of said Southwest quarter of Section 1 as bearing North
00°00'00" West, per the plat of record of Old Town North, and with all bearings
contained herein relative thereto:
Commencing at the Northwest corner of Lot M-20, Block 2 of said Old Town North, said
point also being on the South right-of-way of Alley Y; thence along the North line of said
Lot M-20, North 89028'16" West 2.38 feet to a point on the East line of said east as
described in Reception No. 85028305, said point also being the TRUE POINT OF .
BEGINNING of this description; thence along said East line, South 30919121 " West
817.45 feet to a point on the East right -of -way of Jerome Street; thence along said East
right-of-way 37.26 feet along the arc of a non -tangent curve concave the West, having a
radius of 648.00 feet, a central angle of 3°17'41", and the long chord which bears North
23'18'20" West 37.26 feet to a point on the West line of said easement as described in
Reception No. 85028305; thence along said West line non -tangent to the last described
curve, North 30'19'21" East 778.17 feet to a point on the South right-of-way of Alley Y,
of said Old Town North; thence along said South right-of-way, South 8902816 East
34.57 feet to the true point of beginning.
