KNOW ALL MEN BY THESE PRESENTS: That the undersigned, Daniel R. Bernth, being the
owner of certain real property in Larimer County, Colorado legally described as TR B, SHOPKO PUD, FTC,
PARCEL NUMBER 97362-34-002, and ACCOUNT/SCHEDULE NUMBER R1385780, in consideration
of Ten Dollars ($10.00) in hand paid, receipt of which is hereby acknowledged, and other good and valuable
consideration, does hereby allow the storm drainage water to come across our property as desribed in the
development plan documents associated with SHOPKO P.U.D. , TRACT B from the property described as TR
A, SHOPKO PUD, FTC', PARCEL NUMBER 97362-34-001, and ACCOUNT/SCHEDULE NUMBER
R1385771.
The owners of SHOPKO P.U.D. , TRACT B further state that we shall be responsible for the
maintenance of the storm drainage facilities located on our property as described above and more particularly
described on development plan documents associated with SHOPKO P.U.D., TRACT B.
It is understood by the undersigned that, by acceptance of this Private Use Agreement, the City of Fort
Collins will not accept the duty of maintenance of the storm drainage facilities located on our property as
described above and more particularly described on development plan documents associated with SHOPKO
P.U.D., TRACT B.

signatories under the laws of the State of Colorado. This Certification is based upon an examination of the
records of the Clerk and :Recorder of Larimer County, Colorado as of the date of execution of the Private Use
Agreement and other information discovered by me through reasonable inquiry and is limited as authorized by
