m WHEREAS, Section 2.1.5 of the Land Use Code of the City of Fort Collins authorizes the
0 Director of Community Planning and Environmental Services to vacate certain easements by
m 0 = resolution or by approval of replats containing notation of such dedication; and
o WHEREAS, the Owner has requested that the City vacate portions of a drainage
W = easement located on Pad B of Shopko P.U.D. plat, more particularly described on Exhibits "A",
m N and "B", and
A S WHEREAS, the vacation has been reviewed and approved by the pertinent City
tt m 3 Departments, which departments report no objections to the vacations.

A o NOW, THEREFORE, be it resolved by the Director of Community Planning and
m c m Environmental Services of the City of Fort Collins, that portions of a drainage easement on Pad
w m B of Shopko P.U.D. Plat, located at the northwest corner of Boardwalk Drive and JFK Parkway,

x which portions are more particularly described on Exhibits "A" and "B", attached hereto and
incorporated herein by this reference, be and are hereby vacated.
Passed and adopted at an administrative hearing held by the Director of Current
Planning as the delegee of the Director of Community Planning and Environmental Services of
the City of Fort Collins this a*A day of April A.D. 2004.
