AD0547 OF THE DIRECTOR OF COMMUNITY PLANNING AND ENVIRONMENTAL SERVICES OF THE CITY OF FORT COLLINS VACATING A PORTION OF AN ACCESS EASEMENT LOCATED IN LOT 1 OF MASON STREET NORTH. WHEREAS, Section 2.1.5 of the Land Use Code of the City of Fort Collins authorizes the Director of Community Planning and Environmental Services to vacate certain easements by resolution or by approval of replats containing notation of such vacation; and WHERAS, the Owner has requested that the City vacate a portion of an access easement located on Lot 1 of Mason Street North. More particularly shown on Exhibit "A". WHEREAS, the vacation has been reviewed and approved by the pertinent City departments and outside agencies, which departments and agencies report no objections to the vacation. NOW, THEREFORE, be it resolved by the Director of Community Planning and Environmental Services of the City of Fort Collins, that a portion of an access easement on Lot 1 of Mason Street North located in Fort Collins, Colorado, more particularly shown on Exhibit "A° attached hereto and incorporated herein by reference, is hereby vacated. Based on Brian Shears' letter, it sounds like the window well is already installed and is therefore not conflicting with the electric line. At that point we should only have a cable to feed the streetlights and should not have a problem maintaining that line. We have no objections to the easement being vacated. Collins, Colorado Dear Marc, This is a formal request for the vacation of a portion of the platted eight -foot (8) utility easement along Mason Court near the south section of Building A and near the intersection of Mason Court with Cherry Street. Please note that this portion of the easement is not encumbered by electric utilities. Apparently, no utilities were located or hit at the time of excavation for the south and east portion of building A. The reason for the formal request for vacation of a portion of the eight -foot (8) utility easement is that a concrete basement window well was constructed within the limits of that easement. There is slightly less than two feet (2') of encroachment into the easement. Our intention is to vacate only a portion of the easement that envelops the existing window well. The vacated portion of the easement will be three feet (3') east to west and eight feet (81) north to south. The formal vacation request legal description and exhibit have been prepared by Northern Engineering and is attached with this formal request. Also attached is an 8 1/2 x 11 of the Master Utility Plan prepared by Shear Engineering Corporation to relate the vicinity of Building A to the rest of the Mason Street North project. Dear Susan, SHEAR This is a request for the vacation of a portion of the platted public access easement along the three garages on the southwest side of the Mason Street North project. The reason for the request for vacation of a portion of the easement is that original sitework design layout for the three garages was coordinated with Wolff Lyons Architects, apparently without consideration of a brick veneer. We now have the final design and placement from Wolff Lyons Architects. The garages are a total of 8" wider, apparently due to the addition of a brick veneer. Therefore, an 8" reduction in the easement is required. This is represented on the enclosed exhibit and legal description.
