AD 04-35 —_ OF THE DIRECTOR OF COMMUNITY PLANNING N 0 AND ENVIRONMENTAL SERVICES 0- OF THE CITY OF FORT COLLINS VACATING A m OF A UTILITY AND ACCESSEASEMENT PORTION ON LOT 2, FEENEY SUBDIVISION 0 WHEREAS, Section 2.1 5 of the Land Use Code of the City of Fort Collins authorizes the Director of Community Planning and Environmental Services to vacate certain easements by o resolution or by approval of replats containing notation of such dedication, and WHEREAS, the Owner has requested that the City vacate a portion of a utility and a r L access easement on Lot 2, Feeney Subdivision, located at 3700 South College Avenue on the p east side of College Avenue, south of Horsetooth Road and north of Boardwalk Drive, more tt 3 = W A particularly described on Exhibit "A", and r N N a a WHEREAS, the vacation has been reviewed and approved by the pertinent City N O f Departments, which departments report no objections to the vacation. a NOW, THEREFORE, be it resolved by the Director of Community Planning and Environmental Services of the City of Fort Collins, that a portion of a utility and access easement on Lot 2, Feeney Subdivision, located at 3700 South College Avenue on the east side of College Avenue, south of Horsetooth Road and north of Boardwalk Drive, which portion is more particularly described on Exhibits "A," attached hereto and incorporated herein by this reference, is hereby vacated. Passed and adopted at an administrative hearing held by the Zoning Supervisor as the delegee of the Director of Community Planning and Environmental Services of the City of Fort Collins this 6' day of October A.U. 2004.
