Box 590 Fort Collins, CO 80522 RE: Hearthfire 2°1 Filing Minor Amendment Request for Wetland Mitigation Dear Steve The developer of the Flearlhfire 2n6 Filing PUD is requesting a Minor Amendment to the Final Site and Landscape Plan related to the requirement of the creation of an additional 33 acres of wetland along the west portions of the existing pond and wetland. ']'he City of Fort Collins Land Use Code allows Minor Amendments to approved development plans per Section 2 2.10 ?(d) if the minor amendment does not result in a change in the character ofthe development. This specific request is to allow the creation of additional upland wildlife habitat in the area shown on the Wetlands Mitigation Plan as wetlands create for mitigation in the 2°6 filing. ']'his .33 acres of wetlands is located on the westerly side of the existing pond and wetlands. As a brief history. the Hearthfire Is' Filing was approved in 1997 by the City of Fort Collins and W/o of the homes in this Is` filing have been constructed. The first filing contains approximately 9.5 acres of wetlands around the perimeter of the pond and water surface within the existing pond. The 2nd Filing was approved in 2003 by the City and as a stipulation of I.he Development Agreement; the existing pond needed the completion of the regrading and construction of the island as shown on the 1" Filing Site and Landscape Plans. As part of the construction to the 2" Filing storm drainage improvements, .22 acres of wetlands was disturbed, thereby requiring the creation of an additional .33 acres of new wetlands as mitigation for the disturbed wetlands. It was anticipated that the excavated material from the area of the new wetlands would be use as fill material on the developed site. During the winter of 2003, the developer started construction of the first phase of the 2°h filing and in the spring of 2004 the developer hired another contractor to excavate the pond area and create the island. During the construction process, it was determined that fill material from the wetland area was not needed and therefore the new NA"tii"5 S Design LLC 4225 Westshore Way Fort Collins, CO 80525 (970) 226-1655 • (970) 226-1635 fax wetlands was not created at that time. After the pond reconstruction was completed and the groundwater tilled the pond, it was determined that in order to create the new wetlands, that the area would need to be excavated to a depth of about 7-11 feet thereby causing steep side slopes into the wetland area and possibility a dangerous situation. Lherefore, the developer is requesting this Minor Amendment to allow a modification to the approved Skte and Landscape Plan as well as the Development Agreement to eliminate the required .33 acres of new wetlands and instead leave the area as upland and create additional wildlife habitat in this area. This would be accomplished by removing any existing non-native plant material including Russian Olive trees and thistle, planting additional native trees and shrubs and reseeding the disturbed areas with a native dryland seed mix. These plantings would create a riparian like habitat that would be valuable to many wildlife species. With the existing drip irrigation system in this area, the success of these plantings is likely to he high. Please see the enclosed Mitigation Plan prepared by Wildland Consn�Ilants, Inc. dated May 23, 2005. With this modification, the developer will be providing additional wildlife habitat for the area and with the current amount of existing wetlands as well as the pond reconstruction, we believe that this minor amendment does not result in a change in the character of the development and these improvements are equal to the plan as it currently exists. These improvements are shown on the enclosed red -lined Site and Landscape Plan. 1 have enclosed two (2) copies of the redlined plans and Mitigation Plan for your review and well as the Minor Amendment Application Form and a check in the amount of `h 192.00 as the application fee.
