HomeMy WebLinkAboutWESTBURY PUD SECOND - Filed GC-GENERAL CORRESPONDENCE - 2005-08-30Linder Real Estate September 13, 1996 Mr. Kerrie Ashbeck City of Fort Collins 286 North College Avenue Fort Collins, CO 80524 Dear Kerrie: This letter is to request that the City of Fort Collins vacate a portion of the platted 15 foot utility and drainage easement along the rear of Lots 1-25 Westbury P.U.D. Second Filing. I am requesting a vacation of the southerly 5' of the easement on the rear of Lots 1-14, and a vacation of the northerly 9' of the easement on Lots 15-25. This leaves 10' on Lots 1-14 which contains telephone and cable lines buried in a joint trench 3' south of the north property line, and a 10' wide drainage swale that runs from Lot 4 to Lot 14. The telephone and cable lines are within the swale. On Lots 15-25 there are telephone and cable lines in a joint trench 3' north of the rear lot lines. Tract D is a utility and drainage easement also. Please refer to the attached drawing. I have spoken with Susan Peterson of U.S. West and T.C.I. and both utilities have no problem with the reduction in the easement. The easement should never have been that large to begin with. I originally dedicated by separate instrument to U.S. West a 15' easement along the rear for Lots 1-14 across unplatted land to install the lines to serve Westbury First Filing. I expected this easement to be vacated when the Second Filina was platted and overlooked this. Stewart and Associates made the easement on Lots 15-25 15, also to be the same as on Lots 1-14. This error was my fault. Everything was fine until we started designing floor plans to build on these lots. Many of the lots are only 100 feet deep and with only 30' of lot width to work with, all of the garages have to be on the front of the units. The Zoning Department requires 20' setback from the front of the garage door to the back edge of the sidewalk and with a 20 foot deep garage, the living area really starts 36' back from the property line. We wish to build these homes as duplexes with 10, between each duplex building, Specializing in Development Properties 1500 J.F.K. This starts one unit's living area 40, from the front property line. With a 15' rear utility easement, there simply is not enough lot left to design within, particularly on ranch style units. The two story units do fit on all of the lots with the easements as they are, but the ranches do not. From past experience we estimate that 25-301 of the units will be ranches. This type of housing and maintenance package tends to attract older buyers who do not like stairs. We do not propose to build all units right to the edge of the rear utility easement if this vacation is approved. The purpose of this request is to allow us to mix single story ranch plans into the project on more of the lots. Only the ranch style units will extend (roof overhand) right to the edge of the reduced easement. Since U. S. West and TCI do not object and the drainage Swale is within the reduced 10' easement, I would hope that you approve this request. Concurrent with this vacation request I am submitting an administrative change request to Steve Olt to modify the rear setback on the site plan and character elevations.
