OF THE CITY OF FORT COLLINS
VACATING A UTILITY STORM DRAINAGE EASEMENT LOCATED on block 101,
City of Fort Collins
WHEREAS. Section 2-353 (4) of the Code of the City of Fort Collins authorizes
the Planning anc Zoning Board to vacate certain easements, by resolution or by
approval of replats containing notation of such vacation, and
WHEREAS, the City Manager is requesting the vacation of a permanent storm
drainage easement conveyed by Larimer County through an Easement agreement
dated March 5', 2002, in order to realign the easement area to correspond with the
actual constructed drainage system, and
WHEREAS.. the vacation request has been reviewed and approved by the
pertinent City and private utilities, and they report no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City
of Fort Collins that the storm drainage easement conveyed by Permanent Easement
agreement dated March 5h, 2002, and recorded at reception number 2002025133 of
the Larimer County, Colorado Records, which easement is more particularly described
on Exhibit "A", attached hereto and incorporated herein by this reference, is hereby
vacated.
Passed and adopted at a regular meeting of the Planning and Zoning Board of
the City of Fort Collins held this 21s' day of April A.D. 2005.
