Box 580 Fort Collins, Colorado 80522 RE: JFK Parkway Dear Mr. Hertzig, I am writing this in regards to my conversation with Dave Simpson of Connell Resources, Inc. with respect to the additional fill placed at the north end of the JFK Parkway Project built by Toys- R-Us and Wayne Shrader. I am the landowner of the property directly north of this project and have no objection to the fill placed on this property. I understand there will be a minimum amount of run off from this project and the fill will be seeded and proper erosion control measure will be taken to minimize any erosion. The data submitted from the floors and walls of the East Trench and West Trench were well below the action level of 1000 ppm pentachlorophenol with most samples being below detection limits. We feel the materials remaining in the excavations pose no significant health or environmental threat and the excavations may be backfilled with clean fill. The Division has no objection to the resumption of construction activities in the area of the trenches. This is in reference to the construction of street improvements on the site, specifically the collector street named JFK Parkway. The City will participate financially in the cost of JFK Parkway in accordance with our street oversizing ordinance. In short, the City will reimburse your costs to oversize the street from a residential to the planned collector street. Our policy on collector streets is to reimburse your costs on the middle 14 feet of the roadway, including asphalt pavement, aggregate base course, subgrade preparation, and 14 feet of any water or sewer service lines that may extend across the full width of the street. Although the ordinance prevents me from guaranteeing your request for payment will be honored, sufficient funds are available and appropriated for 1992 construction. $1.2 million was budgeted for street construction reimbursements, and approximately $400,000 has been expended so far this year. I do not anticipate any other large projects this year, and am confident that there will be adequate monies to reimburse your construction costs. On this development project, you are eligible to enter into another program the City has available to recover street construction costs when the property abutting JFK Parkway to the west develops. In this program, you may enter into a "Repayment Agreement" with the City, and the City may try and collect a portion of the street construction costs from any vacant land that abuts and takes access from the street you constructed. The City may try and collect this cost at the time the property V0 develops, and pass this money on to you. This agreement runs for a period of ten years after you construct the street. Collins, CO 80522 Dear Mike: After meeting with Steve Olt and Kerrie Ashbeck, it was suggested that this proposal letter be written to start the process for determining if the City can create an instrument whereby all property owners within the boundaries as stated above would participate in their pro-rata share of public and private improvements for the development of the entire parcel. I would propose that each party's pro-rata share be calculated as follows: Property S.F. I would propose the following costs be shared on a pro-rata basis: Public Improvements - 1. 1/2 of the cost of Bockman Drive. 2. 1/2 of the cost of traffic signal at the intersection of Bockman Drive and South College Avenue. 3. 1/2 of the cost of JFK Boulevard from Boardwalk Drive to Bockman Drive. 4. The cost: of the right-in/right-out on South College Avenue (understanding that this would need approval by CDOT). 5. Costs for utilities not installed as part of the roads (i.e.: telephone conduit in the southern part of the Bockman Drive right-of-way). The connection from Boardwalk Drive to Bockman Drive which would align with the entrance to Fountainhead to the south and to Mitchell Drive on the north. 2. The connection of the right -in -/right -out along South College Avenue to the access drive described above (Private Improvements - #1). 3. The re -development of the Mucklow property which would be completed to accommodate the right-in/right-out and associated connections. It would be proposed that the improvements constructed by each parcel be documented by submitting to the City the actual construction cost after the improvements are completed. The total of all costs would then be revised and each party's new pro-rata share would be calculated. Should the improvements put in by a property owner exceed their pro-rata share then a pro-rata reimbursement would be made to that property owner when other developments are approved via the PUD process. Likewise, if a property owner does no improvements or the improvements on their property are less than their calculated pro-rata share of total costs, then these properties would pay the properties which have constructed inprovements upon approval of a PUD for their property. The purpose of this letter is to outline this concept and hopefully determine an :instrument that could be created which would obligate all property owners within these boundaries to participate in the costs as stated above. I realize that this is a difficult issue, especially considering the pro-rata shares, reimbursements, the calculating costs after completion, etc., however, I would hope that this letter would initiate the discussions necessary to come up with ideas to produce a document that could provide this function. I would appreciate if you could review my requested changes as soon as possible since I realize that you will be on vacation after tomorrow. I would also appreciate it it you could forward these comments to the City Attorney so that he can also review and comment on these requested changes.
