This variance is requested to allow for more than 500 square feet of driveway to drain over the adjacent sidewalk on Dripping Rock Lane. The proposed project is a multi -family project with four (4) drives proposed off of Dripping Rock Lane. At the southwest drive, an inlet is proposed to intercept runoff, at the northeast drive, there is no drainage over the public sidewalk. The northwest and southeast drives have highpoints in the drive past the sidewalk. These walks will have 1,380 square feet and 760 square feet of pavement drainage over the sidewalks respectively. These drives both exceed the 500 square feet allowed in the standard sited above. At a public meeting on May 3, 2002, proposed revisions to this standard were distributed. This document stated that this requirement would be changed to state, "no sheet flow drainage may cross a sidewalk that interferes with the pedestrian use of the sidewalk". It is our understanding that this revised language is in the current standards and that under the current (October 1, 2002) Standards, no variance would be required. This variance from the above Standards will not be detrimental to the public health, safety and welfare. This variance is requested to allow `Local Street' (see attached sketch) to be located 190' south of Hearthside Drive rather than the 250' stated in the Table. This variance should be considered in conjunction with the variance request for Fossil Lake 4`' Filing dated January 15, 2003. This previous request was to allow for reduced tangent lengths on the proposed 'Local Street'. The two streets oppose each other on Ziegler Road in south Fort Collins. In this area, Ziegler Road is a Minor Collector with a 40' flowline to flowline cross section. At the neighborhood meeting, there was concern about the amount of traffic Fossil Lake 4°i Filing would add to Shallow fond Drive to the south. This additional street connection has been proposed as a result of these comments. The street has been designed to be placed as far north (and as far away from Shallow Pond Drive) as possible. The Hearthside Drive intersection is adjacent to the property north of Fossil Lake 4°i Filing and it is not possible to line up the two intersections. It is requested that this variance to the above standard be granted for the following reasons: • The purpose of the street connection is to take as much traffic off of Shallow Pond Drive as possible. We do not anticipate a huge number of residents to use this access, but the further south the access is, the fewer trips it will receive. • There is no cross street connecting to 'Local Street' on the west side of Ziegler; because of parcel geometry, it is extremely unlikely that Hearthside Drive will ever extend to the cast. The two "tee" intersections will have less turning movements than if one were a four legged intersection and the other were a tee. • The 190' of separation proposed will not cause a situation where left turning traffic waiting at either intersection will back up into the other. • Sight distance between the two intersections will not be an issue because of the straight section of Ziegler. Drivers will be able to see movements happening at both intersections clearly. • The proposed variance will address the neighbor's requests. Since the last staff review summary, issued on November 7, 2002, we have held a series of meetings with neighborhood representatives in an attempt to address several of their concerns and perspectives, particularly as related to a direct access to the site from Ziegler Road. As a result, we have submitted two variance requests to the Engineering Department (one on January 15 and one on February 4). Both Troy Jones and Sheri Wamhoff are aware of these factors. The variance requests are to reduce the distance required between intersections on a Collector roadway (Ziegler Road) and to reduce the minimum tangent required between curves. In accordance with Table 7-3 of the Latimer County Urban Area Street Standards (LCUASS) the minimum distance between intersections on a Collector is 250 feet and per Section 7.4.1.A.2 the minimum tangent between curves is 100, feet. The variance to reduce the separation between the future Hearthside Drive being preliminarily platted in the County on the west side Ziegler Road and the local street at the northern edge of the Fossil Lakes 4`h Filing parcel to 190 feet is granted. The variance request to reduce the tangent length on the local street located at the northern portion of the Fossil Lakes 4'h Filing; property to 60 feet is approved. In accordance with Section 9.4.11.13 in the Latimer County Urban Area Street Standards adopted January 2, 2001, no more than 500 square feet of driveway can sheet flow across a sidewalk. The applicant has submitted a variance request to be able to drain more than the 500 square feet of driveway over sidewalk at two of the access points onto the street. In accordance with the request the areas mowing across the sidewalk would be 1,380 and 760 square feet. I think that this variance should be approved for the driveway with 760 square feet of drainage. This does not seem to be a problem. I do think however that the Northwest driveway with 1,380 square feet of area draining across the sidewalk is a bit too much and could be reduced somewhat without great impact to the site, with a variance still being granted, but not to the extent requested. This Fossil Lake design is using curb -and -gutters which create concentrated flows. 9.4.1 ] .A specifically prohibits concentrated flows across sidewalks. My suggestion is to have the curb -and -gutter transition to a flat concrete edge strip, from the high point of the main driveways (or the first garages) to the sidewalks. This would allow for sheet flow into the landscaped areas as well as across the sidewalks. The 760 square feet of driveway draining toward the sidewalk should be about the upper limit of what we would allow without inlets to a pipe system or sidewalk culverts. I believe the NW driveway with the 1,380 square feet of drainage area crossing the sidewalk could be reduced by moving the high point of that driveway to the east by about 40-feet. That in combination with the suggestion above would satisfy our concerns. As always, these variances do not necessarily set precedence or change the application of our design standards in other situations. Dear Michael, This letter is in response to the variance request dated October 8, 2002 to allow for more than 500 square feet of driveway to drain over the adjacent sidewalk for two of the driveways. In accordance with Section 9.4.11.13 of the Larimer County Urban Area Street Standards (adopted January 2, 2001) no more than 500 square feet of driveway can sheet flow across a sidewalk. The variance request: for the Southeast driveway, in which 760 square feet of area would flow across the sidewalk out the driveway, is approved with the following condition. At the high point in the driveway the curb and gutter section shall transition to a flat concrete edge strip which shall run to the back of the sidewalk. This will eliminate the concentrated flows that are prohibited from crossing the sidewalk. The variance request for the Northwest driveway, in which 1,380 square feet of area would flow across the sidewalk out the driveway, is denied. If the area of drainage across this driveway was reduced to 760 square feet of area or less it would be approved with the same condition as the request for the Southeast driveway. College Avenue Fort Collins, CO 80524 Ms. Wamhoff, RECEIVED CURRENT PLANNING This letter is in reference to a significant proposed layout change at Fossil Lake 4°i Filing. KEM has tried to very carefully weigh all of the variables related to the possibility of an access from Ziegler Road to the Fossil Lake 4"' Filing project. The request was initiated by the neighborhood, and KEM believes that (at least some) of the concerns being raised by the neighbors are emotional and not factual. In most considerations, KEM essentially has nothing to gain, except the elimination of the emergency turnaround requirement at the north end of Dripping Rock. We have already assumed additional costs in design services and time delays. There certainly will be further additional costs if the City's preliminary review of the attached proposal is favorable and we proceed with further site re-dcsign and review. And, we believe the change we are proposing actually results in a somewhat less attractive site than the original. In spite of all of the above, solely in the interest of better neighbor relations (for both KEM and the City), KEM would like to propose the access as depicted herewith, understanding that variances to the LCUASS would be required. Please review the attached layout and provide us with an indication of whether or not the City Engineering; Department would grant the necessary variances to allow this layout to be approved. This is not a formal request for a variance, only a request that you provide us with your feedback before significant time and design effort is invested in making the required changes to our design drawings. This variance is requested to allow for reduced tangent lengths on the proposed local residential street connection between Ziegler Road and Dripping Rock Lane. The proposed local street connection is located at the north end of the site and will provide a second access for the site. The street alignment is dictated by the location of an existing gas line easement and adjacent neighborhood desires. The proposed design of the road calls for both intersections to be at 90' to the cross streets and to have two 165' radius curves in the street. It is requested that the tangent lengths be allowed to be less than 100' as specified in Table 7-3 for the following reasons: • The proposed street is only 300' in length. Ziegler Road is existing and Dripping Rock Lane is an extension of the existing street. Both of these street locations are fixed. • The curves in the street meet the Standards and the intersection angles are at 90°. Meeting these two constraints provides for a better design than meeting the tangent length criteria. if the radius was reduced, or if the angles of intersection were skewed, the tangent distances would still not be met and would still require a variance. • Sight distances will not be an issue if the variance is granted. As a driver enters the proposed street from either direction, they will be able to see the stop sign at the opposite intersection (approximately 300'). It is unlikely that the design speed of 25 mph will ever be achieved on this short length of street. This variance from the above Standards will not be detrimental to the public health, safety and welfare. The desires of the neighbors to reduce traffic through the existing neighborhood and the shape of this site have driven this variance request.
